Public Hearing
Rezoning of Approx. 2.5 Acres of Land from Agriculture to Residential
Petitioner: Jason & Amy Hensel & Bryant & Jeanna Schultz
April 10, 2006

Chairman Reitzner explained that this rezoning request was tabled at the March 13, 2006 Rezoning Hearing to offer the petitioners the opportunity to find out if the site would pass soil testing for a septic system, etc.

Present at this meeting were Chairman Jim Reitzner, Chris Newton, Tom Kramer, Dean Birschbach and Roger Grade, along with petitioners Jason Hensel, Owner & Jeanna Schultz, Buyer, along with some town residents.
This property is located on Priepke Road between W8379 and W8399 in the Town of Lamartine. More particularly described as:
Part of the NE ¼ of the NW ¼ and part of the SE ¼ of the NW ¼ of Section 10, T. 15N., R. 16E., Town of Lamartine Fond du Lac County.
The petitioner submitted to the Plan Commission a statement from Bernie Ritger a soil tester, stating that he had conducted a preliminary test and found the soil in this hand dug test hole to be suitable for a mound system. Pictures and a map laying out the property were also submitted.
Discussion took place regarding this rezoning. This area is a mapped wetland and the County would require a wetland delineation to be done. There would be no problem building on this site if delineated.
Dean Birschbach made a motion seconded by Chris Newton that the Plan Commission recommends to the Town Board that this rezoning request be granted. Chairman Reitzner called for a vote on this motion. The results are as follows:
Jim Reitzner—YES, Dean Birschbach—YES, Roger Grade—YES, Chris Newton—YES, and Tom Kramer—NO. The Plan Commission voted 4 to 1 to recommend to the town board that this rezoning request to rezone approximately 2.5 acres of land from Agricultural to Residential be granted.
The following reasons were stated for granting this rezoning. From the Town of Lamartine Zoning Ordinance, Dated June 8, 1998, Pages 27 and 28.
70.6 Standards for Rezoning (These Standards for Rezoning are listed in their entirety. The highlighted items are those given by the Plan Commission as reasons for recommending the granting of this request) #1, #2, #8, and #9.
1. Adequate public facilities to serve the development are present or will be provided.
2. Provision of these facilities will not be unreasonable burden to local government.
3. The land is suitable for development.
4. Development will not cause unreasonable air and water pollution, soil erosion or adverse effects on rare or irreplaceable natural areas.
5. The potential for conflict with remaining agricultural uses in the area.
6. The need of the proposed development location in an agricultural area.
7. The availability of alternative locations
8. The productivity of the agricultural lands involved.
9. The location of the proposed development to minimize the amount of agricultural land converted.
With no further business to discuss, Dean Birschbach seconded by Tom Kramer made a motion to adjourn.
