RE: Revisions to the Town’s Zoning Ordinance, the adoption of an Adult-Oriented Establishment Licensing Ordinance, a Solar Energy Systems Ordinance may be incorporated into the Town’s Zoning Ordinance

Plan Commission (PC) Chairman Jim Reitzner was unable to attend this meeting due to the weather so Town Chairman, Frank Bartzen appointed Plan Commission member Tom Kramer as acting Chairman.

Acting Chairman Tom Kramer called the meeting to order at 6:38 Pm at the Lamartine Municipal Building Meeting Room. Also in attendance at this meeting were PC members, Dan Wepner, Glenn Becker, Carol Kinyon and Roger Grade; Acting Clerk, Greg Michels, Town Chairman, Frank Bartzen, Town Supervisors, Bruce Rhode, Mike Suprenand and Town Attorney Matt Parmentier, as well as members of the Town Board of Appeals and four Town residents.

Tom stated that the purpose of this meeting was for the Plan Commission of the Town of Lamartine to conduct public hearings to consider revisions to the Town’s Zoning Ordinance, the adoption of an Adult-Oriented Establishment Licensing Ordinance, a Solar Energy Systems Ordinance, and revisions to the Town’s Subdivision and Land Division Ordinance. The Solar Energy Systems Ordinance may be incorporated into the Town’s Zoning Ordinance. New ordinances and ordinance revisions may be adopted by the town Board at a Special Town Board meeting immediately following the Plan Commission hearing. The Town Board of the Town of Lamartine will consider the recommendations of the Plan Commission and possibly take action on the new and revised ordinances.

Hearing notices were confirmed with affidavits for publishing and posting on file.

The hearing was then turned over to Town Attorney, Matt Parmentier (Parmentier).
Atty. Parmentier announced that discussion of the Solar Energy Systems Ordinance would be discussed later on at this meeting during the Zoning Ordinance discussion.

Adult-Oriented Establishment Ordinance—Atty Parmentier explained that adult-oriented establishments are a first amendment expression of free speech and cannot be disallowed. He went through the entire ordinance section by section explaining it thoroughly. Parmentier than introduced the “Summary of Secondary Effects Research” which was reviewed and discussed at this public hearing. This information will be kept on file in the Clerk’s office. Parmentier opened the meeting for questions. After all questions were addressed, Glenn Becker seconded by Tom Kramer moved that the PC recommend to the Town Board that the Adult-Oriented Establishment Ordinance be adopted. Five paper ballot votes were cast with the following results: Glenn Becker—YES, Tom Kramer—YES, Carol Kinyon—YES, Roger Grade—YES and Dan Wepner—YES. The motion carried 5-0. Glenn Becker moved to destroy the ballots. Carol Kinyon seconded the motion. Motion carried 5-0.

Attorney Parmentier explained one by one the amendments being considered to the Town Zoning Ordinance as well as the Solar Energy Systems Ordinance that the Town wished to have incorporated into the Zoning Ordinance. The individual pages detailing the changes / amendments to the zoning ordinance and the inclusion of the Solar Energy Systems Ordinance are attached to these minutes (Attachment A).
Roger Grade moved that the Plan Commission recommend to the Town Board that the Zoning Ordinance be adopted with all changes reviewed and discussed at this hearing. Dan Wepner seconded the motion. Five paper ballot votes were cast with the following results: Glenn Becker—YES, Tom Kramer—YES, Carol Kinyon—YES, Roger Grade—YES and Dan Wepner—YES. The motion carried 5-0. Glenn Becker moved to destroy the ballots. Roger Grade seconded the motion. Motion carried 5-0.

Attorney Parmentier than explained the revisions being considered for the Town of Lamartine Subdivison and Land Division Ordinance. Please see Attachment B with these minutes for specific details of these changes.


Carol Kinyon moved that the Plan Commission recommend to the Town Board that the Subdivision and Land Division Ordinance be adopted with all changes reviewed and discussed at this hearing. Glenn Becker


seconded the motion. Five paper ballot votes were cast with the following results: Glenn Becker—YES, Tom Kramer—YES, Carol Kinyon—YES, Roger Grade—YES and Dan Wepner—YES. The motion carried 5-0. Glenn Becker moved to destroy the ballots. Roger Grade seconded the motion. Motion carried 5-0.

With no further business to be considered, Carol Kinyon moved to adjourn the public hearing. Roger Grade seconded the motion. Motion carried 5-0 and the meeting adjourned at 8:25 PM.

Special Town Board Meeting

Town Chairman Frank Bartzen called the Special Town Board Meeting to order at 8:27 PM. Also, present at this meeting were Supervisors Mike Suprenand and Bruce Rhode and acting Clerk, Greg Michels.

Plan Commission Acting Chairman Tom Kramer informed the Board that at the Public Hearing held prior to this meeting the Plan Commission had voted 5-0 to recommend that the Town Board adopt all amendments and revisions discussed at the public hearing as well as the inclusion of a Solar Energy Systems Ordinance into the Town Zoning Ordinance. Kramer further informed the board that the PC had also voted 5-0 to recommend adoption by the Board of the Adult-Oriented Establishment as well as recommending the adoption of the Town Subdivison and Land Division Ordinance with the revisions / amendments reviewed at the public hearing.

Bruce made a motion that the Board accept all the recommendations of the Plan Commission and adopt the new Zoning Ordinance, Adult-Oriented Establishment Ordinance and the Subdivision and Land Division Ordinances. Mike seconded the motion. Frank called for a voice vote with the following results: Frank—YES, Mike—YES and Bruce—YES. Motion carried 3-0.

With no further business to discuss, Mike moved seconded by Frank to adjourn the meeting. Motion carried 3-0 and the meeting adjourned at 8:32 PM.
