Board Meeting Minutes
August 10, 2020
With all notices having been properly posted, Frank Bartzen, Chairman called the August meeting to order at the Lamartine Municipal Building Meeting Room (LMBMR) at 7:00 pm. Also present at this meeting were Supervisors; Randy Kuik and Travis Kloetzke, Treasurer Greg Michels and Clerk; Jill Randall and Deputy Clerk Jessica Randall. Please see meeting sign in sheet for other attendees.

Pledge of allegiance was recited.

Approval of Minutes from Previous Meeting(s)
July Board Meeting Minutes (7/13/2020) – No Corrections were noted. Randy moved to approve the July minutes. Motion seconded by Travis. Motion carried 3-0

Treasurer’s Report – Greg read the July Treasurer’s report aloud. The ending balance as of 7/31/2020 was $ 543,085.87. Frank move to accept the Treasurer’s report as given. Motion seconded by Randy. Motion carried 3-0.


CONDITIONAL USE PERMIT (CUP) REQUEST - Board Action on Recommendation from Town Plan Commission on the Schneider-Wendt Conditional Use Permit (CUP) request to build a “nonfarm residence on property zoned Moderate Farmland”.
This Conditional Use Permit is requested under sec. 7.4 (A)(1) “Nonfarm residences that qualify under Wis. Stat. Ch. 91.46 (1) (d) and defined in Section 3.2 built after January 1, 2014”. The Town Zoning Ordinance allows this to be done by CUP without the need to rezone. A Conditional Use Permit application was submitted by property owner(s) Duane Schneider and Dawn Wendt. The property is described as follows: Parcel I.D’s. No. T12-15-16-15-14-001-00. Property is 1.7 acres of Moderate Farmland Preservation. Located in NW ¼ of SE 1/4, Town 15 North, Range 16 East, Town of Lamartine, Fond du Lac County, Wisconsin.
The clerk reported to the town board earlier the same evening, the PC held a public hearing on the Schneider-Wendt CUP request. The Town PC voted 4—0 to recommend the town board grant the CUP to construct a non-farm residence by CUP without the need to rezone; to construct one single non-farm residence on this property. Randy moved that the town board accepts the recommendation of the PC and grants the Schneider-Wendt conditional use permit to construct a “nonfarm residence on 1.7 acres of land zoned Moderate Farmland” without the need to rezone. Travis seconded the motion. The voice vote results were as follows: Frank—YES, Travis—YES and Randy—YES. The Town Board voted 3-0 to grant a conditional use permit as stated above to Duane Schneider and Dawn Wendt for more information regarding the CUP please see the Plan Commission Public Hearing Minutes dated August 10, 2020.

This Conditional Use Permit is requested under sec. 7.4 (A)(1) “Nonfarm residences that qualify under Wis. Stat. Ch. 91.46 (1) (d) and defined in Section 3.2 built after January 1, 2014”. More particularly described as the West 200’ of South 330’ of SE ¼-SE ¼, Section 15, Town 15 North, Range 16 East, Town of Lamartine, Fond du Lac County, Wisconsin.

The Town PC voted 5—0 to recommend the town board grant the CUP to construct a non-farm residence by CUP without the need to rezone, to construct one single non-farm residence on this property. Frank moved that the town board accepts the recommendation of the PC and grants the Binning’s a conditional use permit to construct a “nonfarm residence on 1.5 acres of land zoned Moderate Farmland” without the need to rezone. Travis seconded the motion. The voice vote results were as follows: Frank—YES, Travis—YES and Randy—YES. The Town Board voted 3-0 to grant a conditional use permit as stated above to Dennis and Karen Binning. Public Comment:
Travis reported that he spoke with the Fire Chief and he approved Round Up to be used around the fence surrounding the ball diamonds to control the weeds. Frank will speak with Justin in regard to this.

REPORTS & COMMUNICATIONS
a. Road Report—Frank reported that Justin has been trimming trees, mowing the ditches, and fixed a couple signs in the township
i. Culvert Permit Report – Frank read the culvert permit received by the town this past month.
b. Monthly Building Permit Report – Frank reported the building report applications issued by Pete Michels.
c. Update on Appointed Clerk Position Referendum-In July the Board passed an ordinance to put a referendum on the November 3rd ballot. A postcard will be sent to town residents to explain why the town board would like the clerk’s position to be appointed instead of elected.
d. Update on Schrubbe Property-Court order was sent to the judge, Township Attorney reviewed with Frank what the property owner sent back. Township will move forward with hearing.
e. Update on Vacation of Foss Rd-Guaranty Title is looking into a couple properties on Foss Rd and the Surveyor says it looks like the township has ownership. Ownership will be reviewed by the Title Company.
f. Update on the Fond du Lac County Farmland Preservation and Comp Plan-A lengthy discussion took place regarding the Farmland Preservation and Comp Plan. Will continue to look into this process.


OLD BUSINESS:
a. Board Discussion- Town Assessment Quotes-Nothing new to report at this time.

NEW BUSINESS:
a. Board Action—New Operator License Application for Elizabeth Huber. Randy moved to approve the operator license seconded by Travis. Motion carried 3-0
b. Board Discussion—Possible work at Anderson Cemetery. A quote was received from Watertown Memorial Co for $3300.00. Greg recommends the town spend $1650.00 to straighten the stones that are leaning and spend the remaining $1650.00 to fix the foundation on as many as possible for the stones that are lying on the ground. Travis seconded by Randy moved to hire Watertown Memorial to complete. Motion carried 3-0
c. Board Action—Approval of CSM for Duane Schneider and Dawn Wendt. Randy moved seconded by Travis to approve the CSM as presented. Motion carried 3-0
d. Board Action—Approval of CSM for Dennis and Karen Binning. Frank moved seconded by Travis to approve CSM as presented. Motion carried 3-0

Approving the monthly vouchers and checks –Frank moved seconded by Randy to approve the check and vouchers as presented. Motion carried 3-0.


Adjournment – Randy seconded by Travis moved to adjourn the meeting. Motion carried 3-0 and the meeting adjourned at 9:30 PM.
