Board Meeting Minutes
August 12, 2019
With all notices having been properly posted, Frank Bartzen, Chairman called the August meeting to order at the Lamartine Municipal Building Meeting Room (LMBMR) at 7:00 pm. Also present at this meeting were Supervisors; Randy Kuik and Travis Kloetzke, Treasurer Greg Michels and Clerk; Jill Randall. Please see meeting sign in sheet for other attendees.

Pledge of allegiance was recited.

Approval of Minutes from Previous Meeting(s)
July Board Meeting Minutes (7/8/2019) – A correction in the minutes was noted. The text that is struck out is incorrect and the new added text is bold and underlined and is what should have been included in the July minutes. Under Reports & Communications: a. Road Report— Frank reported that the ditch mower is down and is in the shop for welding. If the weld doesn’t work, a new part will be needed has been purchased for approximately $1400.00. Randy moved seconded by Travis to approve the July Town Board meeting minutes as corrected. Motion carried 3-0.

Treasurer’s Report – Greg read the July Treasurer’s report aloud. The ending balance as of 7/31/2019 was $ 570,744.30. Frank move to accept the Treasurer’s report as given. Motion seconded by Travis. Motion carried 3-0.

Public Comment:
NONE

REPORTS & COMMUNICATIONS
a. Road Report—Frank discussed paving over/patching the road where culverts were replaced. Randy seconded by Travis moved that paving be done over two culverts crossings. Motion carried 3-0. Frank also reported that the crack filling would be done in the township next week.
i. Culvert Permit Report – Frank read the culvert permit received by the town this past month.
b. Monthly Building Permit Report – None presented this month.
c. Update on Sex Offender Ordinance -Attorney to send town amendments if needed – Town Attorney Parmentier is working on updating the towns’ Sex Offender Ordinance. He feels that there will only be one change that may be required to bring the current ordinance up to date.
d. Update on Pinno Drive – Frank reported that approximately 3 weeks ago the DNR was at this location to do a wetland delineation. A survey was completed to identify the town road right of way. Some issues were discovered with fence being 6.5-feet on the towns’ property. Discussion took place as to what may need to be done so water does not go over this road anymore during excessive amounts of rain. If the road needs to be raised Frank feels that some professional engineering needs be done so the town knows it is done correctly. The county will not core the road yet to see what soils are beneath as they feel that they will likely hit water. Frank will get a proposal from an engineering company and construction estimate and the board can decide how they want to move forward when they see the estimated costs.
e. Update on Ordinance Codification per town attorney—Frank spoke with the town attorney Matt Parmentier regarding this matter. Matt said the board should review the ordinances on file and decide which ones they want to continue with and which ones are old, outdated and have been replaced by an updated ordinance. Then bring to him what we want to keep and he will review them and advise as to what new ordinances the town may want to consider adopting.
f. Update on options for a Municipal Court – Frank spoke with North Fond du Lac and Lamartine would be able to be a member of their municipal court. The town would have to complete some paperwork and purchase software for $550 - $600. Frank also spoke with Rosendale about Lamartine joining in with them. They would be interested in taking Lamartine in with them but, would not be able to do it until May of next year. This matter will need to be research further.
g. Selecting Budget Workshop Meeting Date – 2020 budget workshop will be held for elected officials on Tuesday, October 22, 2019 at 6:00 PM.
h. Update on Woodland Estate Paving – The paving and shouldering on Thomaswood Trail and Thomaswood Ct will be completed by September 1, 2019. Northeast Asphalt will be doing the road work (shouldering by others) with sections of the road being milled first.

OLD BUSINESS:
a. Paperwork for DOT Funding for Road and Culvert flood damage – The paperwork is ready to submit to the DOT. Frank is trying to find out if the paperwork can be submitted electronically. The town will be receiving $7000 back for the repairs of the road and culvert due to flooding. This is all but $400 recouped for these repairs.
b. Discussion – Town Attorney Advises Ordinance “Ability to Regulate Short Term Rental Properties (Airbnb & VRBO). The attorney recommends that the town adopts this ordinance when it is completed.

NEW BUSINESS:
a. Board Action—Changing October Board Meeting to the 1st Monday (Oct 7th) due to WTA Convention being held on the second Monday (normal Board Meeting night). Randy moved that the town change the October board meeting to Oct. 7th. Frank seconded the motion. Motion carried 3-0.
b. Board Action – Cut three dead trees down at the Veteran’s Park – Greg reported that three bids were sought for the removal of three dead trees at the park. Jacob Tree Service bid was $1800.00 with no reseeding. Riese Tree Service bid was $2400 including reseeding. Frank seconded by Randy moved to hire Jacob Tree Service provided all taxes were up to date and the town will reseed this area. Motion carried 3-0.

Approving the monthly vouchers and checks –Randy moved seconded by Frank to approve the check and vouchers as presented. Motion carried 3-0.


CLOSED SESSION: Frank read the following aloud; the Town Board intends to convene into closed session pursuant to Wis. Stat. 19.85(1) (g) for the purpose of conferring with legal counsel for the Town who is rendering oral or written advice concerning strategy to be adopted by the Town with respect to litigation in which it is or is likely to become involved. Travis seconded by Randy moved that the board go in to closed session.

Adjournment – Travis seconded by Randy moved to adjourn the meeting. Motion carried 3-0 and the meeting adjourned at 9:30 PM.
