Rezoning of Approximately Seven (7) Acres of Land from Agriculture to Residential
Petitioner: Jason and Sandra Karst

The Clerk made introductions.

Plan Commission (PC) Chairman Jim Reitzner called the meeting to order, noting that this hearing would be informal. Also present at this meeting were the remainder of the PC members; Dean Birschbach, Tom Kramer, Roger Grade and Glenn Becker, Clerk Jill Randall and petitioners Jason and Sandra Karst (Karst).

This property is owned by Karst and is located at W7441 County Road OOO in the Town of Lamartine, more particularly described as:

Parcel NO. T12-15-16-01-15-002-00
S1 T15N R16E That PT SW ¼ SE ¼ LYG S of RR ROW V471-78 EXC CSM #1615-9-115 (758101) Town of Lamartine, Fond du Lac County, Wisconsin.

The Clerk read the letter of intent. The letter dated October 15, 2009 from Karst requested this seven acre parcel be divided into three (3) parcels and all 3 parcels be rezoned from Agricultural to Residential. The center parcel has an existing home which Karst would like to sell and keep the remaining 2 parcels on each side of the home site as crop land.

Jim asked if the petitioner had any further comments, concerns or additions. Jason had nothing more to add to the letter of intent, but, he did want to point out that the maps that he submitted to the PC were not drawn to scale. The property would be surveyed and the parcels divided as equally as possible if the rezoning was granted.

Chairman Reitzner asked if any letters of opinions were received regarding this rezoning.

The Clerk read a letter of opinion from Fond du Lac County Planner Sam Tobias. In an email dated November 30, 2009, Mr. Tobias recommended the Karst property be rezoned to residential. He listed the following reasons for this recommendation:
1. Fields are too small for modern farm machinery
2. The property is located on the east side of the Town in a less intensive ag area
3. The property is located on the side of the Town that the Comprehensive Plan identifies as the preferred area for future non-farm development
4. The property is buffered on the north from other farmland by the Mascoutin Valley State Park Trail and on the south from CTH OOO…
5. Land to the east and west of the Karst property is zoned A-1 but uses are residential. Residential development has been gradually infilling the CTH OOO corridor from Fond du Lac to CTH I and to the Mascoutin Trail on the north over the past many years.

No letter of opinion was offered by, Town Building Permit Issuer, Pete Michels.

Discussion took place regarding this rezoning.

Dean Birschbach made a motion to recommend to the Town Board that they approve the rezoning request. Glenn Becker seconded the motion. Discussion took place regarding the map submitted by Karst with hand drawn property lines. One of the dividing lines jogs over to include an out building on the parcel of land Karst may possibly retain instead of selling it with the home site. It was suggested that this line be squared off and the out building stay with the home site parcel to make the property lines straight. Dean amended the motion to recommend approving the rezoning the way it was requested by the petitioner (as Karst had hand drawn the property lines). Glenn Becker seconded this motion. Let the record show that five votes were cast with the following results: Jim—NO, Roger—YES, Tom—YES, Dean—YES, and Glenn—YES. Jim stated that he voted NO because he was against the property line not being straightened out. The Plan Commission will recommend this rezoning to the Town Board. The PC stated that the reasons to rezone are the same as those offered by Sam Tobias.

Glenn Becker seconded by Jim Reitzner made a motion to adjourn the meeting. Motion carried 5-0.

The Town Board will decide the Karst rezoning request at the January 11, 2010 Town Board meeting at 7:30 PM at the Lamartine Municipal Building Meeting Room.
