Ordinance Amending Zoning Ordinance
Regarding Mobile Tower Siting
February 10, 2020 at 6:00 PM
The Town of Lamartine Plan Commission (PC) held a public hearing to receive public comment and then to vote on a recommendation to the Town Board regarding adoption of the proposed amendment to the Town of Lamartine Zoning Ordinance. Chairman, Jim Reitzner called the meeting to order at the Lamartine Municipal Building at 6:00 Pm. Also present at this hearing were Plan Commission members; Dan Wepner, Glenn Becker, Tom Kramer and Katie Deaver. Chairman Reitzner read aloud that the purpose of the meeting was to receive public comment on a proposed Ordinance Amending Zoning Ordinance Regarding Mobile Tower Siting. The proposed ordinance amends the Town’s existing Zoning Ordinance to regulate by zoning permit the siting and construction of mobile service support structures and related facilities, including co-locations. Adoption of this ordinance will amend the Town of Lamartine Zoning Ordinance (Adopted March 26, 2014).
Proper hearing notice, publishing and postings were confirmed.
Chairman Reitzner asked Town Chairman Frank Bartzen to explain why these changes were needed. Frank explained that the Town Attorney, Matt Parmentier was advising that the town amend the zoning ordinance to include this new mobile tower siting. Doing so will provide for the regulation by zoning permit; 1) the siting and construction of any new mobile service support structure and facilities; 2) with regard to a class 1 collocation, the substantial modification of an existing support structure and mobile service facilities; and 3) with regard to a class 2 collocation, collocation on an existing support structure which does not require the substantial modification of an existing support structure and mobile service facilities. Frank further explained that the town attorney would help the town through the permitting process should the town receive application(s) regarding mobile tower siting. This ordinance allows the town to collect permit fees and may impose additional conditions on the permit if not prohibited by Wis. Stat.§ 66.0404.
Public Comments: Chairman Reitzner asked if there were any public comments regarding this subject. Some discussion took place but no public comments were received for or against this mobile tower siting amendment.
With no further comments, Reitzner closed the public comment portion of the hearing.
The Plan Commission discussed the proposed amendment to the zoning ordinance regarding mobile tower siting.
Glenn Becker moved that the Plan Commission recommends the Town Board adopts the “Ordinance Amending Zoning Ordinance Regarding Mobile Tower Siting”. Tom Kramer seconded the motion. Motion carried 5-0. Let the record show that the roll call vote is as follows: Jim Reitzner—YES Dan Wepner—YES, Katie Deaver—YES, Glenn Becker—YES & Tom Kramer—YES.
The Plan Commission moved on to the next order of business beginning at 6:30 PM. (Wallace Conditional Use Permit hearing). Jim Reitzner announced that the Town Board would act on this recommendation from the Plan Commission at the Town Board regular monthly board meeting at 7:00 Pm this same evening.
