The Town of Lamartine Plan Commission (PC) held a public hearing in response to a request to rezone (+/-) twenty (20) acres of land, from Moderate Farmland Preservation District to Residential. The property is described as follows:

Parcel I.D. No. T12-15-16-27-16-001-00 described as the East ½ of the SE ¼ of the SE ¼ of Section 27, Town 15 North, Range 16 East, Town of Lamartine, Fond du Lac County, Wisconsin. This property is located at N5308 Hillcrest Road in the Town of Lamartine and is owned by Bennett Connell.

Chairman Jim Reitzner called the meeting to order. Plan Commission (PC) members also present at this meeting were: Dan Wepner, Marvin Bosveld, Tom Kramer and Glenn Becker. Plan Commission Secretary, Jill Randall, Petitioner, Bennett Connell and his realtor for this property sale; Steve Klapperich were also in attendance. Proper hearing notice, publishing and postings were confirmed.

The Secretary read the Rezoning Application aloud.

Chairman Reitzner invited the petitioner to explain their request to rezone this property. Steve Klapperich spoke on behalf of Mr. Connell. He explained that Mr. Connell was in the process of selling this 20-acre parcel of land. He wished to have the property divided into four residential parcels. Lot #1 – 4.043 AC with a residential home currently situated on this parcel; Lot #2 5.010 AC (land only); Lot #3 5.003 AC (land only); and Lot #4 5.034 AC (land only). There is a 10-foot utility easement between each lot. Mr. Klapperich stated that there was a potential for only three new homes and the larger acreage per lot kept a rural feel. He further stated that soil evaluations passed for sanitary systems for each lot. The DNR was contacted and met with Mr. Klapperich at the property; there are two DNR mapped wetlands on the property and both are wetlands less than 2 acres. A small band of poorly drained soils surrounds the mapped wetlands. County shoreland and floodplain zoning do not apply to the property.

Public Comments: Joe Birschbach, N5309 Hillcrest Road: Mr. Birschbach asked where driveways would be located and would the property owner be removing the semi-trailer stored on the property. Frank Bartzen, Town Chairman explained that the driveway/access points were required to be a specific number of feet apart and would be determined later. Mr. Klapperich said that they could be assured that the semi-trailer would be removed and if the PC liked they could put that as a condition of rezoning.
With no further comments, Reitzner closed the public comment portion of the hearing.

Plan Commission discussed the rezoning request. In summary the PC felt that this rezoning fit with the town plan and this parcel of land likely should have been earmarked as transitional property being connected to the unincorporated “village” and many surrounding residential uses.

Glenn Becker moved that the Plan Commission recommend to the Town Board that this rezoning request be granted and +/- 20 acres of land be zoned residential with the condition that the semi-trailer currently stored on this property be removed when the weather permits. Tom Kramer seconded the motion. Chairman Reitzner called for a vote with the following results: Jim Reitzner—YES, Dan Wepner—YES, Marvin Bosveld—YES, Glenn Becker—YES and Tom Kramer—YES. Motion carried 5-0.

Chairman Reitzner asked the secretary to represent the Plan Commission and give the PC’s recommendation to the Town Board at their upcoming monthly board meeting; Monday, February 8, 2016 at 7:00 PM; where the Board will take action on this rezoning request.

With no further business, Dan Wepner seconded by Marvin Bosveld moved to adjourn the meeting. Motion carried 5-0 and the meeting adjourned at 6:45 Pm.
