Plan Commission Meeting
Animal Siting Ordinance
February 25, 2008 at 7:00 PM

Present at this meeting were Jim Reitzner, Dean Birschbach, Roger Grade & Tom Kramer. Plan Commission (PC) member Chris Newton was absent.
With all notices having been properly posted, PC Chairman Jim Reitzner called the meeting to order.
Eric Fowle of East Central WI Regional Plan Commission (ECWRPC) began the meeting by reading over and explaining a DRAFT—Feb. 2008 version of the “Findings of Fact With Respect to the Location and Siting of Future Large Livestock Operations Within the Town of Lamartine…” A copy of this document is attached to these minutes in the clerk’s office (Attachment A).
Discussion took place regarding these Findings of Facts with mention of having the town attorney look it over before it is officially adopted by the town.
Eric pointed out that there are two (2) areas on the map entitled “Existing Zoning with Proposed A-1 Enterprise and A-1 General Agricultural Zoning Districts” that have question marks. The PC needs to decide if it is appropriate to have this property on the map. One of the guiding policies for choosing land to include was to stay west of CTH Y and South of STH 151.
Eric will check to see if town land owners whose land is in this plan have to be personally notified regarding when the public hearing will take place. Eric will also check to see if it can be recommended that all ag traffic will be on state and county roads. Current existing facilities will remain as they are now. New facilities would be under the new traffic restrictions.
Eric offered a rough idea of a time frame as to what happens next:
1. PC concurrence on document and map
2. PC takes action to recommend to the Town Board to review and decide when and if the town attorney reviews the document
3. Attorney reviews document
4. A public meeting is held where the PC votes to recommend that the Town Board adopts the ordinance.
The PC needs to decide what lands they want left on the map.
Eric explained that the reason the Town wanted to write an Animal Siting Ordinance was so the Town could divide up the land in different zones where the Town wants different size animal facilities. The Town is applying stricter rules as to where certain size facilities can be put in the township. The Town’s ordinance will also address traffic control. If the Town did not have their own Animal Siting Ordinance it would be forced to use the state plan which allows animal facilities to be anywhere that fits the criteria and does not address traffic issues.
Tom Kramer made a motion to take the properties with question marks off the ma[ that are East of CTH Y and let the landowners come to the PC if they want their land on. Roger Grade seconded the motion. Motion carried 4-0. The questioned properties will be taken off the map.
Jim Reitzner moved to recommend that the Town Board move forward with the plan as amended. Dean seconded the motion. Motion carried 4-0.
Eric stated that he would get the updated map and materials to all; he will check out zoning landowner amendments and Finding Facts regarding traffic. He will also look into landowners having to be notified and how the public hearing has to be published/posted.
With no further business to discuss, Dean Birschbach seconded by Roger Grade made a motion to adjourn the meeting. Meeting adjourned at 8:25 Pm.
