PUBLIC HEARING
ON THE PROPOSED DISCONTINUANCE OF TOWN HIGHWAYS
February 8, 2016

With all notices for this meeting being properly published and / or posted; Town Chairman Frank Bartzen called the meeting to order. Present at this meeting were Supervisors Bruce Rhode & Roger Grade, Town Attorney Matt Parmentier, Treasurer Greg Michels and Clerk Jill Randall. Eleven people signed in on the attendance sheet at this meeting; please note that there were several people that attended this meeting but did not sign in. (The attendance sign-in sheet is filed with these minutes).

Frank stated that the purpose of this meeting was to consider the discontinuance of several Town highway(s); Ballwanz Road, Darling Road, Giebel Road (also known as Sunnyview Road / Brian Michels property), and Sunnyside Drive. Frank noted that the process of discontinuation included Waldson Road but, Waldson Road was being withdrawn at this time and will not be discontinued by the town. Frank then turned the meeting over to Attorney Parmentier. Attorney Parmentier reviewed the procedure the Town of Lamartine has been following to legally discontinue the four (4) public highways and return them to private roads. The statue requires the town to conduct this public hearing as one of the final steps of road discontinuation. The Town will hear public comment on this matter. The Town Board will then take action on the discontinuation of these roadways at the regular Town Board meeting this same evening at 7:00 Pm. Matt further explained that if the discontinuations are approved, upon recording of the documents (March 30, 2016) ownership will revert back to the landowner. The town will add gravel and grade the roads and give them back in good condition April 1, 2016.

A few questions were addressed by the Board. No one spoke against the discontinuation of any of the four roads. Attorney Parmentier explained that Obrien’s (Waldson Road) as we went through the process the County informed the town that Waldson was not a flag lot and requires all property owners to agree and that is not the case for Waldson Road/Drive so the town is NOT moving forward with this road. Waldson will remain a public road that others are allowed to travel.

With no further comments or discussion, Roger made a motion to adjourn with a second by Bruce. Motion carried 3-0 and the meeting adjourned at 6:20 Pm.

The Board is scheduled to take action on this matter of road discontinuations at the Town Board meeting
February 8, 2016 at 7:00 Pm.
