TOWN OF LAMARTINE
Board Meeting Minutes
Minutes Dated: January 14, 2013
With all notices having been properly posted, Frank Bartzen, Chairman called the January meeting to order at the Lamartine Municipal Building Meeting Room at 7:30 Pm.
Supervisors Mike Suprenand and Bruce Rhode, Clerk Jill Randall and Treasurer, Greg Michels were also in attendance.
The Pledge of Allegiance was recited.
Frank called for any corrections or additions in the December Board Meeting minutes.
Mike seconded by Bruce made a motion to accept the December Board meeting minutes as presented.
Motion carried 3-0.
Frank asked Greg to read the Treasurer’s report. The ending balance as of 12-31-12 is $1,217,360.16. Greg noted that this total reflects tax collection money. Bruce moved to approve the December Treasurer’s report as presented. Mike seconded the motion. Motion carried 3-0.
A citizen asked if comments would be allowed during the time of board discussion on agenda item “New Business A” regarding checking township properties for excessive unlicensed vehicles. Frank stated that questions would be addressed at the time of this agenda item discussion.
Concern was addressed regarding a tree on Hillcrest and Brown Road that possibly needs to be removed. This item will be addressed at the February 11th Town Board meeting.
REPORTS AND COMMUNICATIONS:
A. Road Report—Frank reported that he received some phone calls about snow removal during the 12/20/12 snow storm. All four rigs were out clearing the snow after the storm. The snow was very deep and wet making removal slow. Frank stated that the road crew did a great job! Roads and culverts are coming up; our roads this winter are not looking so good.
B. Report -- Highway 23 Study Committee Letter—Frank reported that the Hwy 23 study committee is considering future (15-20 years) plans of Townline Road extending from Hwy 23 to Scott Street. This would be drawn on the “official Map” so anyone building etc. would be aware of this future possibility.
C. Report -- Wind Tower Legislation—The Town Attorney recommends that Lamartine do nothing now. If an application comes before the Town we would have 90 days to put an ordinance together retroactive to the application date.
D. Report -- Township Comprehensive Plan Mandatory 2013 Update—The Plan Commission will meet on Monday, February 4, 2013 at 7:00 Pm at the Lamartine Hall for an informational meeting regarding the Comprehensive Plan update and the role of the Plan Commission.
E. Frank announced that the Town Caucus would be held Saturday, January 19, 2013 at 1:00 Pm at the Lamartine Municipal Building Meeting Room
A. Reappointment of Plan Commission Members Roger Grade and Tom Kramer—Bruce made a motion seconded by Mike that Roger Grade and Tom Kramer be reappointed as regular members to the Plan Commission for another three year term ending January 2016. Motion carried 3-0.
A. Approval from the Board to check township properties for excessive unlicensed vehicles—Frank explained that there were four properties in the township that looked like they had excessive unlicensed vehicles. He would like board approval for himself and Constable Birschbach to speak to the property owners about this issue. Mike seconded by Bruce moved that the board approve Frank and Harold go to these property owners and inform the people of the County / Township unlicensed vehicle ordinance. Motion carried 3-0.
B. Approval from the Board to seek legal opinion regarding sharing the annual Federal Fish & Wildlife Payment—Frank explained the Township receives approximately $1100.00 annually from the Federal Fish and Wildlife Services. The Town has never shared this payment with the school district, County, State or MPTC. The Town recently received a letter dated December 12, 2012 from the Fond du Lac County Corp. Council stating that they have been informed by the Fond du Lac County Treasurer, Julie Hundertmark, that the township has not been paying over to Fond du Lac County its share of this revenue. The letter further asked that the Town of Lamartine remit to the County its share of the revenue received in 2010 and 2011. Frank explained that this is not the first time that the County has inquired about their share of this payment. This matter has been researched by the Town and others and no one can seem to prove to the Town that this payment must be shared. Even phone calls to the Federal Fish and Wildlife Services could not determine for certain that this payment must be shared with other entities. The Town feels that the federally owned property that this payment is for is located on a town road which the town maintains; and if no one can show that these funds have to be shared than the town would retain the entire amount received. Mike moved that Frank talk to the Town Attorney regarding this matter. Bruce seconded the motion. Motion carried 3-0.
C. Approval to renew an operator’s license to Joe Michels—Mike moved seconded by Frank to approve the renewal of an operator’s license for Joe Michels. Motion carried 3-0.
Approving the monthly vouchers and checks—Frank seconded by Mike moved to approve payment of the monthly checks and vouchers as presented and give permission to the clerk and treasurer to pay Advanced Disposal the annual contract fee and J. Maul the annual maintenance fee. Motion carried 3-0.
Adjournment—Bruce moved seconded by Mike to adjourn the meeting. Motion carried 3-0 and the meeting adjourned at 8:50 Pm.
