Public Hearing
Rezoning of Approx. 4.3 Acres of Land from Agriculture to Residential
Petitioner(s): Ed and Julie Woodley

The Clerk made introductions.
Chairman Jim Reitzner called the meeting to order, explaining that this hearing would be informal and all parties would have a chance to speak.
Present at this meeting were: Chairman Jim Reitzner, Randy Abitz, Tom Kramer, Dean Birschbach and Roger Grade, along with petitioner Ed Woodley.
This property is located at W7744 Forest Ave Road or more particularly described as
S14 T15N R16E Lot 1 CSM #3773-21-12 LOC in the NE1/4 NE ¼
(V1006-902) 4.312 acres.
The Clerk read the letter of intent. Dated November 23, 2005. The letter stated that Mr. Woodley wished to divide his 4.3 (+/-) acre lot into two separate lots, the larger of the two lots would remain his current residence and the additional lot approx. 1.9 acres would be sold for future home construction. This property is currently zoned Exclusive Agricultural and for this land division to occur it would have to be rezoned to residential.
Chairman Reitzner asked if the petitioner had any further comments or additions to the letter of intent. Mr. Woodley had no further comments at this time.
Chairman Reitzner asked if there was an opinion offered on this rezoning request from Fond du Lac County Planner Sam Tobias or Town Building Permit Issuer Pete Michels. No opinions/recommendations were offered.
Larry Conger—W7902 Forest Ave Road voiced a concern regarding water problems if this property is developed. Discussion took place regarding water problems on and near Forest Ave Road.
Discussion took place regarding this rezoning. The Plan Commission noted that development of this property was not anticipated in the town’s long-range plan and that the soil rating of this property was good. Mr. Woodley stated that soil tests indicate that the property is suitable for two mound systems.
Dean Birschbach made a motion to recommend to the Town Board that this rezoning be granted. Roger Grade seconded the motion. Chairman Reitzner called for a vote. Five votes were cast with the following results:
Jim Reitzner—NO, Randy Abitz—NO, Tom Kramer—NO, Dean Birschbach—YES and Roger Grade—YES. Motion failed. The Plan Commission will recommend to the town board that this rezoning request to rezone 4.3 acres of land from Agricultural to Residential be denied.
(This meeting was not adjourned as the Plan Commission needed to meet to decided the Haney Rezoning request tabled at the December 12, 2005 meeting.
