Zabel Family Trust Rezoning Request
Call to Order – Chairman Frank Bartzen called the meeting to order. Also present at this meeting were Supervisors, Roger Grade and Randy Kuik as well as Clerk, Jill Randall.
Frank explained the purpose of this meeting was for the board to take action on the Plan Commission’s recommendation on the rezoning petition from the Zabel Family Trust.
The Town Plan Commission held a Public Hearing at 6:30 this same evening on a request from the Zabel Family Trust to rezone (+/-) 20 acres of land, from Concentrated Farmland Preservation District to Rural Residential. The property is described as follows: Parcel I.D. No. T12-15-16-08-02-001-00 described as the South ½ of the NW ¼ of the NE ¼ of Section 8, Town 15 North, Range 16 East, Town of Lamartine, Fond du Lac County, Wisconsin. This property is located on Giebel Road in the Town of Lamartine and is owned by Zabel Family Trust, C/O Jordan Zabel.
The Clerk read the Plan Commissions’ recommendation as follows; The Plan Commission voted 5-0 to recommend to the Town Board that this rezoning request be granted and (+/-) 20 acres of land be zoned to Rural Residential with the condition that the “Right to Farm” language per Mr. Butzke be added to the certified survey map.
Board discussion took place. Section 5.6 “Rezoning of Land Out of a Farmland Preservation Zoning District” of the Town of Lamartine Zoning Ordinance was reviewed and discussed.
Randy moved to accept the recommendation of the Plan Commission to grant the rezoning request from the Zabel Family Trust to rezone 19.501 acres of land from Concentrated Farmland Preservation to Rural Residential with the following conditions: (1) Language is added to the Certified Survey Map (CSM) regarding the “Right to Farm” with the language being approved by Frank and Jill. (2) Language be added to the CSM stating that only one residence can be erected on this parcel of land and no further splits will be allowed. Motion seconded by Frank. Let the record show the voice vote as follows; Frank—YES, Roger—YES & Randy—YES. Motion carried 3-0. The Board offered the following reasons to rezone;
Sam Tobias’ opinion, the Plan Commission’s recommendation and the rezoning supports all four of the findings listed under Section 5.6 “Rezoning of Land Out of a Farmland Preservation Zoning District” in the Town of Lamartine Zoning Ordinance.
With no further business to discuss, Randy moved seconded by Roger to adjourn the meeting. Motion carried 3-0 and the meeting adjourned at 7:35 Pm.
