ZONING ORDINANCE AMENDMENTS
June 12, 2017 at 6:00 PM
The Town of Lamartine Plan Commission (PC) held a public hearing to receive public comment and then to vote on a recommendation to the Town Board regarding adoption of the proposed amendments to the Town of Lamartine Zoning Ordinance. Chairman, Jim Reitzner was absent at the start of the meeting so Tom Kramer, Acting Chairman called the meeting to order at the Lamartine Municipal Building at 6:05 Pm. Also present at this hearing was Plan Commission regular members; Carol Kinyon, Dan Wepner Glenn Becker and at 6:20 PM Jim Reitzner. Please see the meeting sign in sheet filed with these minutes for other attendees. Tom Kramer read aloud the following proposed amendments to the Town of Lamartine Zoning Ordinance (Adopted March 26, 2014) as stated in the Class II notice published in the newspaper.
1. Section 8.6 (A) – The insertion of new language in 8.6 (A) 2, setting the minimum acreage for a farm residence or non-farm residence created by a conditional use. Please Note: The current language in 8.6 (A)(2) will default to 8.6 (A)(3). That language will remain the same. The PC Secretary noted that the published notice incorrectly stated “created by a conditional use”. This is a permitted use in the General Agricultural District and does NOT require a conditional use.
2. Section 14.0 Signs – Delete current language in this section and replace with new language regarding signs or make reference to a new standalone Sign Ordinance.
3. Section 20.0 Access Control Ordinance – Amend the Access Control Ordinance currently contained within the Town Zoning Ordinance or make reference in this section to a new standalone Town Access Control Ordinance.
Proper hearing notice, publishing and postings were confirmed.
Acting Chairman Kramer asked Town Chairman Frank Bartzen to explain why these changes were needed. Frank explained that in the Town of Lamartine Zoning Ordinance each zoning district has a section describing what is permitted in that district. The sentence / language regarding “Minimum Lot Size, Height, and Yard Requirements in Section 8.0 General Agriculture (AG) 8.6(A) language was inadvertently left out and needs to be added so this section is consistent with all the rest of the districts. Also the Plan Commission was to review new language to amend Section 14.0 Signs in the Town Zoning Ordinance, but a draft copy of these changes was not yet available for review by the PC so this amendment will not be considered at this public hearing. The Town Attorney, Matt Parmentier suggests that in the interim the town adopts “An Ordinance to Impose a Temporary Stay on Issuance of Sign Permits” for a period of six months so the town has time to review the section on signs and make any desired changes. Frank further stated that the last amendment to the Zoning Ordinance was to repeal the Access Control Ordinance in Section 20.0. The Towns’ Access Control Ordinance was contained in Section 20.0 when the Zoning Ordinance was adopted in March 2014. The Town Board made numerous changes to the Access Control Ordinance and adopted the new ordinance in December 2016. The Town board wants this Access Control Ordinance to be a standalone ordinance and would like to repeal it from the Zoning Ordinance.
Public Comments: Acting Chairman Kramer asked if there were any public comments regarding any of the proposed Zoning Ordinance amendments. Some discussion took place regarding these changes but no public comments were received for or against any of these requested amendments.
With no further comments, Acting Chairman Kramer closed the public comment portion of the hearing.
The Plan Commission discussed the proposed amendments.
Carol Kinyon moved that the Plan Commission recommends the following language be added to SECTION 8.6(A) as number 2. “One (1) acre is the minimum acreage for a non-farm residence created by CSM, subdivision or a conditional use as part of a farm consolidation including surrounding buildings. Please note that the current language in 8.6(A)(2) will not change but will default to 8.6(A)(3). The Plan Commission also recommends to the Town Board that Section 20.0 Access Control Ordinance be repealed as the Town in December 2016 adopted a new standalone Access Control Ordinance. Glenn Becker seconded the motion. Motion carried 4-0. Let the record show that the roll call vote is as follows: Jim Reitzner abstain from voting as he missed the discussion held earlier at this meeting. Dan Wepner—YES, Carol Kinyon—YES, Glenn Becker—YES & Tom Kramer—YES.
Dan Wepner moved that regarding amendment of Section 14.0 Signs; the deletion of old and addition of new language in this section of the Town of Lamartine Zoning Ordinance; the Plan Commission recommends that the Town Board takes action to impose a six (6) month moratorium on the issuance of any sign permits in the township. Carol Kinyon seconded the motion. Motion carried 5-0 with a roll call vote as follows: Dan Wepner—YES, Carol Kinyon—YES, Glenn Becker—YES, Jim Reitzner—YES & Tom Kramer—YES.

With no further business to discuss, Glenn Becker moved seconded by Carol Kinyon to adjourn the public hearing. Motion carried 5-0 and the hearing adjourned at 6:40 PM. Tom announced that the Town Board would act on these recommendations from the Plan Commission immediately following this hearing at the Town Board regular monthly board meeting.
