Animal Siting Ordinance
June 4, 2008 at 7:00 PM
Lamartine Municipal Building Meeting Room
Present at this meeting were Jim Reitzner, Dean Birschbach, Roger Grade & Tom Kramer. Plan Commission (PC) member Chris Newton was absent.
With all notices having been properly posted, PC Chairman Jim Reitzner called the meeting to order. He read aloud the motions made from the minutes of the February 25, 2008 Animal Siting Ordinance meeting. Dean seconded by Roger moved to approve the minutes as presented. Motion carried 4-0.
Eric Fowle of East Central WI Regional Plan Commission (ECWRPC) began the meeting by explaining that a copy of DRAFT—Feb. 2008 version of the “Findings of Fact With Respect to the Location and Siting of Future Large Livestock Operations Within the Town of Lamartine…” had been forwarded to the Town Attorney for review. Atty John St Peter made a few minor adjustments/word smithing to this document and Eric had a revised copy. Eric also had copies of the map with the properties previously marked with a question mark removed from the map. Discussion took place regarding the Findings of Fact document and the newly revised map. Eric asked for a vote from the Plan Commission (PC) to recommend to the Town Board that they approve the map and ordinance the version marked “REVISED Feb. 2008”. Larry Ford addressed a concern he had on page 13 D. Application Fee 1) An initial , non-refundable application fee of $1000.00 shall accompany an application. Additional fees may be requested from the petitioner to reimburse the Town… Larry stated that he understood that only a $1000.00 application fee could be charged and no additional charges could be charged. The Town will check with the attorney regarding this concern.
Tom Kramer moved that the Plan Commission accepts as is the Zoning Ordinance Amendments for Livestock Siting (ATCP 51) and map and forward it to the Town Board to send to the attorney for review. Dean Birschbach seconded the motion. Discussion took place clarifying that the March 2008 map and the Ordinance dated Feb 2008 are the two things to go to the attorney for review. Motion carried 4-0 to pass it on to the Town Board.
Eric explained that the next step would be for the Plan Commission to hold a Public Hearing after the attorney reviews the ordinance, unless there are changes they need to discuss. Eric will attend the public hearing. Eric will send the entire packet to the clerk with some extra maps. A copy of the same information will be sent to DATCP. The Town will check with the attorney are the proper procedure for posting and publishing the public hearing.
With no further business to discuss, Dean Birschbach seconded by Roger Grade made a motion to adjourn the meeting. Meeting adjourned at 7:45 Pm.
