RE: Request for a Conditional Use Permit – Orvis Real Estate LLC
June 6, 2016 6:30 P.M.

Plan Commission Chairman, Jim Reitzner called the meeting to order at 6:30 Pm at the Lamartine Municipal Building Meeting Room. Plan Commission members also in attendance at this meeting were, Dan Wepner, Tom Kramer, and Katie Deaver. Jill Randall served as the PC Secretary at this meeting.
Hearing notices were confirmed with affidavits for publishing and posting on file.
Jim stated that the purpose of this Public Hearing was to receive public comment and a recommendation from the PC regarding a request received for a Conditional Use Permit (CUP) to create a non-farm residence which will have better than 1:20 ratio and will not take tillable land out of production. This Conditional Use Permit is requested under Section 16.10 C 1. in the Lamartine Zoning Ordinance. The property use will be a new home for a family member. The current zoning of this property is: Intensive Farmland Preservation (IFP) and the current use of the property is; Ag use, the existing home was torn down and a pole building is on site.
The PC Secretary read the Conditional Use Permit Application submitted by David Jacob, Jacob Land Surveying, LLC on behalf of the property owner: Orvis Real Estate LLC, petitioner Joe Lemiesz.
The location of the petitioned property is N6131 County Road T.
Parcel I.D’s. No. T12-15-16-18-15-001-00 and T12-15-16-18-16-001-00 Approximately seven (7) acres of future CSM located in the SE ¼, Sec.18, Town 15 North, Range 16 East, Town of Lamartine, Fond du Lac County, Wisconsin.
The CUP application was found to be complete and all fees were paid.
Chairman Reitzner asked Mr. Lemiesz if he had any other information or comments to add. Mr. Lemiesz stated that he had nothing more to add.
Chairman Reitzner asked if there were any comments in favor or in opposition to the request for a CUP. The Clerk noted that all adjoining property owner’s had been notified by letter of this public hearing. No phone calls or letters were received by the town regarding this petition. Reitzner asked if the PC had any further questions or concerns.
With no further questions or comments, Tom Kramer moved seconded by Katie Deaver, that the Plan Commission recommend to the Town Board that this request for a conditional use permit to create a Non-Farm parcel be granted. Chairman Reitzner asked for a voice vote explaining that a yes vote would be to grant the CUP request and a no vote would be to deny the CUP request. Let the record show that four PC members voted (voice votes) with the following results:
Jim Reitzner – YES, Tom Kramer – YES, Dan Wepner – YES and Katie Deaver – YES.
Motion carried 4-0 to recommend approval of a Conditional Use Permit to create a Non-Farm parcel in an Intensive Farmland Preservation as described above.
The Town Board will take action on the Plan Commissions’ recommendation at the regular Town Board meeting; June 16, 2016 at 7:00 Pm at the Lamartine Municipal Building Meeting Room.
With no further business to be considered, Dan Wepner moved to adjourn the public hearing. Tom Kramer seconded the motion. Motion carried 4-0 and the meeting adjourned at 6:40 PM.
