Town Board Meeting Minutes
Dated: March 12, 2007


With all notices having been properly posted, Ed Montsma, Chairman called the March meeting to order at the Lamartine Municipal Building Meeting Room at 7:30 Pm.

Supervisors Mike Suprenand and Frank Bartzen, Treasurer Greg Michels and Clerk Jill Randall were also in attendance at this meeting.

Ed led the Pledge of Allegiance.

Ed then called for any corrections or additions in the February Board Meeting and Special Town Meeting minutes. Mike made a motion seconded by Ed to approve the February minutes as presented. Motion carried 3-0.

Ed asked Greg to give the February Treasurer’s report. The Treasurer’s report was read aloud with an ending balance of $517,149.08 as of 2-28-2007. Frank made a motion to approve the Treasurer’s report as given. Mike seconded the motion. Motion carried 3-0.

CITIZEN CONCERNS:

Greg asked the Board to consider contacting St. Stephens Church to inquire if the Town could place a posting board on their property. The posting board at Knaus Cheese is no longer assessable to the public. Semi trucks, trailers etc. block the view of the posting board that is currently there. A new larger posting board should be built to replace this board. Frank made a motion that the Town contacts St. Stephens Church to see if they would give the Town permission to have a posting board on the church property. Mike seconded the motion. Motion carried 3-0.

Ed and Helen Haney asked why the Constable was on their property without coming to the door first to let them know that he was there. The Board will speak to the Constable regarding this situation.

The Chairman and Clerk signed the certified survey map for the Gerard Giebel property.

REZONING DECISION

Norbert and Kathleen Hoerth request to rezone approximately five (5) acres of land from Agricultural to Rural District to construct a home for their primary residence. The property is located near N6685 County Road C in the Town of Lamartine, Fond du Lac County, Wisconsin. More particularly described as being:

Section 7, T15 N., R16 E. SE ¼ of the NE ¼, South 375 feet from the North property line along County Road C and East approximately 580 feet in the Town of Lamartine, Fond du Lac County, Wisconsin.

Plan Commission (PC) Chairman, Jim Reitzner reported that the PC voted 4-0 at a public hearing regarding this rezoning, held earlier this same evening to recommend to the Town Board that this rezoning request be granted.

Mike Suprenand read the definition of Rural District Zoning. Excerpt from the Town of Lamartine Zoning Ordinance Dated June 8, 1998, Page 21, Section 6, 6.1—Purpose: The purpose of the RD District is to provide areas for mixed agricultural and residential uses and hobby farm operations. This district is generally composed of lands which are currently developed or used for non-agricultural purposes or which because of location, soils, existing development, ownership patterns or other physical characteristics are not highly suited to productive long-term crop uses.

Discussion took place regarding this rezoning.

Frank made the motion seconded by Mike that the Board accept the Plan Commissions recommendation and approve the Hoerth rezoning request. Ed noted that the Hoerth’s did not have to request a rezoning of this property to build a home for them, but choose to do so to make it all cleaner. He then called for a ballot vote stating that a YES vote would mean the rezoning would be granted and a NO vote would mean the rezoning would be denied. Let the record show that three paper ballots were cast with the following results: Ed—YES, Mike—YES and Frank—YES. The Town Board voted 3-0 to approve the rezoning request to rezone five (5) acres of land from Agriculture to Rural District. The following reasons were stated for approving this rezoning request.

From the Town of Lamartine Zoning Ordinance, Dated June 8, 1998, Pages 27 and 28.

70.6 Standards for Rezoning (These Standards for Rezoning are listed in their entirety. The highlighted items are those given by the Town Board as reasons for approving this request) #1, #2, #3, #4, and #5.

1. Adequate public facilities to serve the development are present or will be provided.
2. Provision of these facilities will not be unreasonable burden to local government.
3. The land is suitable for development.
4. Development will not cause unreasonable air and water pollution, soil erosion or adverse effects on rare or irreplaceable natural areas.
5. The potential for conflict with remaining agricultural uses in the area.
6. The need of the proposed development location in an agricultural area.
7. The availability of alternative locations
8. The productivity of the agricultural lands involved.
9. The location of the proposed development to minimize the amount of agricultural land converted

The Board also stated that they believe this rezoning fits the purpose of Rural District.

Frank seconded by Mike, made a motion to destroy ballots. Motion carried 3-0.

REPORTS AND COMMUNICATIONS

A. Road report—

Ed reported that the cracks in the road from the winter thaw are starting to close, and hopefully the roads will come out ok from this winter. Frank made a motion seconded by Mike that the Town post the roads. Motion carried 3-0.

B. Property Clean-ups

1. Aigner Property—CTH OO—Ed reported that he has made two unsuccessful calls to Bill Bent an attorney with County Corporation Counsel regarding this property. It is still in the County’s hands.
2. Schmitz Property—W8251 Hwy 23—The Board has given him until next month.
3. Roehl Property—N5602 Fairview Road— The Board has given him until next month.
C. Update on Cemetery/Veterans Memorial Committee Mtg 2/15/07—Ed reported that the committee decided to send out postcards to all the Town Residents requesting help with names of veterans to be placed on the memorial. They also discussed writing an article for the local newspapers. Thank yous were sent out for donations received for the memorial fund. The names of the donators will not go in the newsletter. The committee decided that they prefer that the names on the memorial be inscribed rather than lasered on. They also discussed the placement of another granite stone in front of the memorial that would read “Dedicated in honor of the Lamartine Veterans” with the insignia of all branches of the service. The committee has approximately 650 veteran names so far. The next Cemetery / Veterans Memorial Committee Meeting will be held at the Lamartine Municipal Building Meeting Room on March 15, 2007 at 7:30 Pm.

D. Update on Town Road/Driveway Committee progress—Greg reported that the committee met with the Town Attorney and David Jacob regarding what roads the Town would be able to turn back to the property owners. The committee is waiting for the attorney to draft resolutions for these roads. The next Committee meeting date and time will be set when the attorney has this information ready.

E. Update on new Town Sub-Division Ordinance—March 8, 2007 at 7:00 Pm at the Lamartine Municipal Building Meeting Room, the Ordinance Committee met to review the new Sub-Division Ordinance drafted by Attorney St Peter. The Ordinance Committee recommended that the suggested changes be looked over by absent committee members, Greg Michels and David Jacob and then the changes will be submitted to Atty St. Peter’s office for his opinion on the changes and a new draft of the ordinance.

F. Meeting date for Town of Lamartine and Town of Fond du Lac to discuss water drainage problems on Townline Road. The meeting will be held on Monday, March 26, 2007 at 7:00 Pm at the Town of Fond du Lac Townhall, located at W5990 W. Pioneer Road.

G. EMSAC Update—Frank reported that a new EMS Director and Fire Chief has not been hired yet. The North Fond du Lac Village Board stopped the process and will hire a new administrator first, and will then proceed with the hiring of an EMS Director and Fire Chief.

H. Town Road Clean up Day—the annual Town Road Clean up Day has been scheduled for Saturday April 28, 2007. A lunch for all the volunteers will be held at the Lamartine Municipal Building Meeting Room this same day from 11:00 Am to 12:30 or 1:00 Pm. If you have any questions or would like to volunteer please contact Dolores Braun at 929-0663 or Jodi Suprenand at 923-5987. The Board asked the clerk to call Veiola regarding their recent letter requesting that all town residents put their garbage in bags to keep loose garbage from blowing out of the garbage and recycling trucks.

OLD BUSINESS

A. Don Gerlach and Harold Haney offering information to the board regarding the drainage problems for the Town of Lamartine property owners on Townline Road. Discussion took place regarding the drainage problems. Mike seconded by Frank made a motion that the Town send a letter to the DNR requesting that they look at this drainage problem of the Townline Road ditches. Motion carried 3-0.

NEW BUSINESS

A. Discussion / decision regarding paying the increase of $100.00 per month for the Road Supervisor’s Health Insurance. Discussion regarding paying the insurance increase has been postponed until the minutes are searched for a previous decision the Board made regarding a limit on how much the Town would pay for the Road Supervisor’s health insurance.

B. 2007 Budget Amendment—The Clerk requested a budget amendment. To decrease Acct#53311-03 “Reserved for Payroll Carryover” by $250.00 and move this money to Acct#55120-00 “Memorial—Veteran’s” so the Town can track the expenses for the Veteran’s Memorial. Frank made a motion that the budget be amended as requested. Mike seconded the motion. Motion carried 3-0.

MONTHLY CHECKS AND VOUCHERS

Frank seconded by Mike made a motion to approve the monthly vouchers as presented. Motion carried unanimously.
