Rezoning of Approx. 2.5 Acres of Land from Agriculture to Residential
Petitioner: Jason & Amy Hensel & Bryant & Jeanna Schultz
March 13, 2006
The Clerk made introductions.
Chairman Jim Reitzner called the meeting to order, noting that this hearing would be informal.
Also present at this meeting were: Chris Newton, Tom Kramer, Dean Birschbach and Roger Grade, along with petitioners Jason Hensel & Bryant & Jeanna Schultz.
This property is located on Priepke Road between W8379 and W8399 in the Town of Lamartine. More particularly described as:
Part of the NE ¼ of the NW ¼ and part of the SE ¼ of the NW ¼ of Section 10, T. 15N., R. 16E., Town of Lamartine Fond du Lac County.
The Clerk read the letter of intent dated January 23, 2006 from Mr. & Mrs. Schultz. The letter stated that the Schultz’s wished to purchase approximately 2.5 acres of land from Jason Hensel to build a home. The letter further stated that there would be no division of the 2.5 acres; this property would be for the building of this one home only. The property has not been used for agricultural purposes for many years presenting no conflict between agricultural and residential use.
Chairman Reitzner asked the clerk to read the letter of opinion offered on this rezoning request from Fond du Lac County Planner Sam Tobias. The letter dated February 21, 2006 from Mr. Tobias stated that the land proposed for purchase and development is all DNR mapped wetlands as well as poor soils for septic systems and agriculture. He recommended that the land in question remain zoned as A-1 as the land is not suitable for home construction because it is low and wet. He anticipates that it would be nearly impossible to obtain a DNR or Corps of Engineers permit to build on this site.
Jim asked if the petitioner had any further comments or additions to their above letter of intent. The petitioners explained that the land has not been soil tested yet but they felt it would perk. Only a little over an acre would be actually taken out of agriculture with this rezoning.
The Plan Commission discussed this rezoning requested. Concern was expressed as to permits from the DNR being able to be obtained, if the site was suitable for building and the actual measurements of the site and where the building would actually be placed on the property.
Dean Birschbach made a motion that the Plan Commission recommends the Town Board grant this rezoning. Motion failed due to lack of a second.
Tom Kramer made a motion to table the vote until next month in the interim the petitioners would define the boundaries and get word from the DNR as to any interference the building would have with the wetland. Chris Newton seconded this motion. Chairman Reitzner called for a vote on this motion. The results are as follows:
Jim Reitzner—NO, Dean Birschbach—NO, Roger Grade—YES, Chris Newton—YES, and Tom Kramer—YES. This rezoning request will be tabled until next month, giving the petitioners some time to gather further information regarding this property.
Chairman Reitzner stated that this hearing was adjourned until next month, and prepared for the next rezoning petition to be heard.
