Town of Lamartine Plan Commission
Rezoning of Approximately 36 Acres of Land from Agricultural to Residential
Petitioner: Rejesh Gupta, Owner

Property is located at the southeast corner of the intersection of State Highway 23 and Fisher Road. It is immediately north of the existing residential properties on Treptow Lane, in the Town of Lamartine, Fond du Lac County, Wisconsin. More particularly described as being:
Parcel I.D. No. T12-15-16-11-09-001-00 described as the NE ¼ of the SW ¼ of Section 11, Range 16 East, Town of Lamartine, Fond du Lac County, Wisconsin, excepting CSM No. 2912, V. 15, P. 171 and excepting lands lying within the right-of-way of State Highway 23.
The Clerk made introductions.
Chairman Jim Reitzner called the meeting to order. Plan Commission (PC) members also present at this meeting were: Roger Grade, Tom Kramer, Glenn Becker and Carol Kinyon. Petitioner, Rajesh Gupta and David Jacob, Jacob Land Surveying LLC were also in attendance.
Proper hearing notice, publishing and postings were confirmed.
Presentation by David Jacob on behalf of petitioner Rajesh Gupta, summarizing this rezoning request. Jacob explained that Gupta owned 36 acres of land which the town marked on the zoning map as AG Transitional land. The new Town Zoning Map and Town Zoning Ordinance amendments, were adopted by the Town Board on August 11, 2010 and December 21, 2010 respectively. Mr. Gupta would like to now have this land rezoned to Residential for the purpose of constructing single family homes. At the time of this hearing there was no definite plan as to how many lots would be created. Jacob offered copies of three possible plat layouts. Layout #1 contained 27 Lots (this was the original plan that Gupta had previously brought before the PC). Layout #2 was designed to accommodate 12 lots, and Layout #3 showed a creation of 20 lots. Jacob explained that phase 1 of the project would likely be to create three lots off from Fisher Road via certified survey map. This would enable them to sell a few lots and use that capital for funding more work on the project. They will have to follow all requirements of the State and County, as well as the Town’s Subdivision Ordinance. There will be two plat reviews by three divisions of the State, as well as the County and Township. Storm water plans, road design and access ways will all be addressed as required at the appropriate time. Mr. Jacob further stated that the plan will be designed to meet all the requirements of the Town Subdivision Ordinance.
Chairman Reitzner opened the meeting up for public comments for or against this request. He asked that any who wished to speak please state their name and address:
Frank Bartzen, W8403 Orchard Road—Asked if the covenants written for this subdivision would include the three phase one lots. The petitioner stated they would be included in the covenants.
Bob Hasse, W7949 Treptow Lane—Stated that he was not speaking for or against the rezoning. He just wanted to make the petitioner aware of potential water problems in the area they wish to construct homes as well as some other questions.
Jim Wiley, N6593 Fisher Road—Confirmed the water problems in the area. He also offered some other comments but none were for or against this rezoning.
Mike Erdmann, W7965 Treptow Lane—Did not speak for or against the rezoning. Mr. Erdmann stated that he would like to be able to see the design of the subdivision.
Kelly Potratz, W7976 Treptow Lane—Stated that a new subdivision would mean extra vehicles, extra people etc. and she was not sure that she wanted that.
Ed Haney, W7604 Forest Ave Road—Addressed questions about the possible layout of the subdivision.
Wayne Bartelt, W7952 Treptow Lane—Addressed concerns of traffic etc.
Jim Wiley, N6593 Fisher Road—Asked how many wells one area could support? No Answer to this question.
Bruce Rhode, N5097 Palmer Road—Commented that this land does lie in the AG Transitional area where the town planned to have growth.
PC Chairman Jim Reitzner ask if there were anymore comments. Hearing none he thanked those who spoke. The PC discussed the rezoning request.
Roger Grade moved to recommend to the Town Board approval of the Gupta rezoning request to residential. Carol Kinyon seconded the motion. Jim called for a vote with the following results: Jim Reitzner—YES, Roger Grade—YES, Carol Kinyon—YES, Glenn Becker—YES and Tom Kramer—NO. Motion carried 4-1.
With no further business, Carol Kinyon seconded by Glenn Becker moved to adjourn the meeting. Motion carried 5-0 and the meeting adjourned at 7:40 Pm.
