March 26, 2014 Public Hearing - Plan Commission Recommendation to Board for Adoption of Amended Zoning Ordinance

RE: Amendments To Town’s Zoning / Farmland Preservation Ordinance

Plan Commission Chairman Jim Reitzner called the meeting to order at 6:30 Pm at the Lamartine Municipal Building Meeting Room. Plan Commission members also in attendance at this meeting were, Dan Wepner, Roger Grade, Tom Kramer and Marvin Bosveld. Jill Randall was serving as the PC Secretary at this meeting.

Hearing notices were confirmed with affidavits for publishing and posting on file.

Jim stated that the purpose of this Public Hearing was to receive public comment and a recommendation from the PC regarding adoption of the final amended / updated Zoning / Farmland Preservation Ordinance. The Department of Agriculture, Trade and Consumer Protection (DATCP) has reviewed the Farmland Preservation section of the zoning ordinance and certified it on December 23, 2013. The DATCP Order Certifying the Ordinance is contingent upon the Town of Lamartine adopting the certified ordinance before March 31, 2014. The Town Board is scheduled to act on the PC recommendation at a Special Town Board meeting immediately following this Plan Commission Public Hearing.

The hearing was then turned over to Town Chairman, Frank Bartzen.
Frank summarized the changes made in the ordinance. He explained the ordinance was “cleaned up”. There were some inconsistencies in setbacks etc. through out the ordinance as well as several errors in the table of contents, titles, directives in the text as to locations of information to be found in other places in the ordinance that were not correct, and other small corrections similar in nature. Prior to 1/1/2014, all residential properties in the Farmland Preservation districts were listed as conditional uses. As of 2/1/2014 they are now permitted uses. This will help owners in the future should they sell their properties or if their properties suffered a loss due to fire, weather and / or other causes. Frank further explained that the only changes to the Zoning map, was a change in the heading of Ag Transitional to General Agricultural. The Zoning map incorporated with this ordinance and also certified by DATCP is dated December 17, 2013.
DATCP certified this Ordinance through December 31, 2023.

Chairman Reitzner asked if there were any comments or questions from town residents or the PC. With no comments or questions; Roger Grade moved that the Plan Commission recommend to the Town Board adoption of the Zoning / Farmland Preservation Ordinance certified by DATCP December 23, 2013 and the Zoning map dated December 17, 2013. Dan Wepner seconded the motion. Let the record show that five members of the Plan Commission unanimously voted to recommend adoption as stated in the motion. Jim Reitzner—YES, Tom Kramer—YES, Marvin Bosveld—YES, Roger Grade—YES and Dan Wepner—YES. The motion carried 5-0.

With no further business to be considered, Tom Kramer moved to adjourn the public hearing. Marvin Bosveld seconded the motion. Motion carried 5-0 and the meeting adjourned at 7:00 PM.
