TOWN OF LAMARTINE
Monthly Town Board Meeting
Minutes Dated: May 10, 2010

With all notices having been properly posted, Frank Bartzen, Chairman called the May meeting to order at the Lamartine Municipal Building Meeting Room at 7:30 Pm.

Supervisor Bruce Rhode, Clerk Jill Randall and Treasurer Greg Michels were also in attendance at this meeting. Supervisor Mike Suprenand was absent.

The Pledge of Allegiance was recited.

Frank called for any corrections or additions in the April Board Meeting minutes.
Bruce made a motion to accept the April Board meeting minutes as presented. Frank seconded the motion. Motion carried 2-0.

Frank asked Greg to read the April Treasurer’s report. The ending balance as of 4-30-10 is $571,406.19. Bruce seconded by Frank moved to accept the Treasurer’s report as given. Motion carried 2-0.

Citizen Concerns: NONE

REPORTS AND COMMUNICATIONS:
A. Road Report—Frank reported that Rich has been adding gravel to the gravel roads, replacing road signs that are being knocked down by someone and is working on the new mowing tractor. The Town received delivery of the tractor and is waiting for the mower to arrive next week.
a. Crack Filling Bid—Frank listed the roads that are earmarked to be crack filled this season. A bid was received from Crack Filling Services for $14,800.00. Frank made a motion that the town approves this bid for crack filling. Bruce seconded the motion. Motion carried. 2-0.
B. Zoning Ordinance Update—Meeting with Warren Utecht (Consultant), Plan Commission & Town Board—to review changes to the recommended Zoning Ordinance text & map based upon the certification review by the state (DATCP)—Meeting held April 15, 2010—Frank reported that the above meeting was held. The Town has received a certification letter from DATCP. The Updated Zoning Ordinance is certified by the state. This approval only lasts to the end of 2011, then the plan must be in compliance with Fond du Lac County’s Plan which must be done by January 2012. The state is not very happy with our breakdown of the AG categories but did approve it. Frank offered a big thanks to the Plan Commission, Town residents; everyone as this was a tough plan to get through. The public hearing to present and hear public comments on the Zoning Ordinance Update before it is adopted will be held on Tuesday, June 8, 2010 at 6:30 Pm at the Lamartine Municipal Building Meeting Room. All are encouraged to attend.
C. Update on the Veterans Memorial / Cemetery Committee Meeting held Apr. 26, 2010—Greg Michels reported that the committee had nine (9) new names to add to the memorial and one name already on the memorial needed a “Sr.” put behind it. This engraving work will be done before Memorial Day. New benches are now at the memorial site. The teacher that worked with students previously cleaning up the cemetery spoke to the committee. She explained what they will be doing at the cemetery this next year. Greg summarized work that needs to be done at the cemeteries. There are several rotten or bad trees that must be removed, a fence that needs to be taken down and some stumps that need to be removed. Some tree work will cost $1365.00. The Town does not have this money in the budget for this year so it may not be able to be done right away. The committee also discussed Community Day. Discussion regarding music and food will be talked about at future meetings.
D. Update Roadside Clean up Day—Held Saturday, April 24, 2010—The clean up day went well. 42 people came to eat the appreciation meal at the town hall.
E. Clean Sweep—May 14, 2010—County wide—Drop off items at Cty Fairgrounds Expo Building—Noon to 4:00 Pm—Brochures are available at this meeting for anyone interested.
F. Board of Review—May 19, 2010—6:00 Pm to 8:00 Pm—you must get an “Objection to Assessment” form from the Town Clerk, if you wish to come to the Board of Review.

G. Date for Next Newsletter—The next newsletter is scheduled to be out by the end of July.
H. Board of Appeals terms expire in June 2010 for Greg Michels, Mike Pittler and alternate members Randy Kuik and Paul Derecks—Frank will talk to these BOA members.

OLD BUSINESS:
A. St. Stephen’s Church drainage concerns—Update—Frank has received culvert prices and will meet with Rich to make sure they are complete. Work specifications will be put together and sent out to contractors. Frank will get the specs to the church.

NEW BUSINESS:
A. Discussion / decision on UW Extension Letter date 4/30/2010 regarding well water testing—Frank explained that UW Extension has invited the township to participate in well water testing. Frank will check with the UW Extension to find out the cost and what it all involves.
B. Discussion / decision regarding Water heater/water system at the municipal building—Frank reported that the heating element in the water heater in the municipal building was recently replaced. There were five inches of sludge in the bottom of the water heater. The town may want to consider installing a water softener. Greg will get the building committee together to discuss possibly installing a water softener.
C. Discussion / decision regarding Town Road Restoration Agreement—Frank explained that years ago the Town had began to put a Town Road Restoration Agreement in place. The purpose of this agreement was to have the town resident that was having large heavy equipment in and out of their property, sign an agreement and put some money upfront for possible damage to the town road. This document was drawn up by the attorney the town employed at the time. The Town Board adopted the agreement pending a couple of changes and turned it back over to the attorney for completion. The completed agreement was never received by the town from the attorney. The town adopted a new Road Restoration Ordinance in March 2010 and would now like to have the Town Road Restoration Agreement in place. Discussion took place regarding the amount of security the town would demand. The Town would require a resident building or working with heavy equipment traveling a town road to pay a security or offer some type of financial assurance and sign the Town Road Restoration Agreement prior to issuing a building permit. This item was postponed until June Board Meeting so Mike would be present to offer his viewpoint.
D. Discussion / decision on conducting a 2010 dog count—Frank made a motion seconded by Bruce to conduct a dog count this year. Motion carried 2-0.

Approving the monthly vouchers and checks—Bruce made a motion seconded by Frank to approve payment of the vouchers presented with the exception of a $40.00 payment to the Oshkosh Area Humane Society (this check was to be voided and a letter sent to the Humane Society explaining that this was not a Town of Lamartine charge) and the $9,900.00 check to Service Motors Company which was approved for payment but, would be held until the Town receives the mower. Motion carried 2-0.

Adjournment-Mike seconded by Frank moved to adjourn the meeting. Motion carried and the meeting adjourned at 9:00 PM.
