RE: Request for a Special Use Permit – Land of Gold Revocable Trust
May 12, 2014 6:00 P.M.

Plan Commission Chairman Jim Reitzner was absent for this meeting. Tom Kramer was appointed acting PC Chairman.
Acting Chairman, Kramer called the meeting to order at 6:00 Pm at the Lamartine Municipal Building Meeting Room. Plan Commission members also in attendance at this meeting were, Dan Wepner, Roger Grade, Carol Kinyon and Glenn Becker. Jill Randall served as the PC Secretary at this meeting.
Hearing notices were confirmed with affidavits for publishing and posting on file.
Tom stated that the purpose of this Public Hearing was to receive public comment and a recommendation from the PC regarding a request received for a Conditional Use Permit (CUP) to create a five (5) acre Non-Farm Parcel in the Concentrated Farmland Preservation Zone.
The PC Secretary read the Conditional Use Permit Application submitted by Jeff Butzke, dba Compass Surveying LLC on behalf of the property owner: Land of Gold Revocable Trust and prospective purchaser Matt Reinke. The petitioned Conditional Use is for the house and five acres of land located at W8551 Priepke Road, Eldorado, WI. Parcel Number T12-15-16-04-16-001-00 & T12-15-16-09-01-002-00. More particularly described as: A part of the Southeast ¼ of the Southeast ¼, Section 4 and a part of the Northeast ¼ of the Northeast ¼, Section 9, T. 15N. – R. 16 E., Town of Lamartine, Fond du Lac County, Wisconsin. The current zoning of this property is Concentrated Farmland Preservation District. The current property use is Residential. The CUP was requested under Section 6.4 sub. A(2) to create a non-farm residence for this Base Farm Tract. The CUP application was found to be complete and all fees were paid.
Chairman Kramer asked Mr. Butzke if he had any other information or comments to add. Mr. Butzke provided copies of a Certified Survey Map (CSM) to review the layout of the 5 acres as well as where the house and buildings were situated. Mr. Butzke explained that property owner Gilbert VanderGalien had entered into a two (2) year least agreement on this five acres and the house with Matt Reinke. Mr. Reinke has done extensive work to the house / property and now would like to purchase the property outright. Mr. Butzke also noted that this land division if approved by the Town of Lamartine would leave a balance of 3.011 acres remaining for future use for a Non-Farm Residence on this Base Farm Tract.
Chairman Kramer asked if there were any comments in favor or in opposition to the request for a CUP. Hearing none Chairman Kramer asked if the PC had any further questions or concerns. A concern was addressed regarding future land divisions on this five acre parcel if approved. If approved this CUP would not allow a lot to be sold off without first coming to the Town Board and requesting a change in the original Conditional Use Permit.
With no further questions or comments, Glenn Becker moved seconded by Carol Kinyon to close the public comment portion of the meeting. Motion carried 5-0.
Glenn Becker moved that the Plan Commission recommend to the Town Board that this request for a conditional use permit to create a five (5) acre Non-Farm parcel be granted. Carol Kinyon seconded the motion. Chairman Kramer asked for a voice vote explaining that a yes vote would be to grant the CUP request and a no vote would be to deny the CUP request. Let the record show that Roger Grade abstained from voting on this issue stating that he is a neighbor. Four PC members voted (voice votes) with the following results:
Carol Kinyon – YES, Tom Kramer – YES, Dan Wepner – YES and Glenn Becker – YES.
Motion carried 4-0 to recommend approval of a Conditional Use Permit to create a five (5) acre Non-Farm parcel in a Concentrated Farmland Preservation as described above.
With no further business to be considered, Roger Grade moved to adjourn the public hearing. Glenn Becker seconded the motion. Motion carried 5-0 and the meeting adjourned at 6:25 PM.
