RE: Public Information Meeting – Town Initiating Rezoning of Non Conforming Parcels

With all notices having been properly posted, Jim Reitzner, Plan Commission Chairman called the meeting to order at 6:30 Pm at the Lamartine Municipal Building Meeting Room. Other Plan Commission (PC) members present at this meeting were Tom Kramer, Roger Grade, Carol Kinyon and Marvin Bosveld.
Jim turned the meeting over to Town Chairman, Frank Bartzen. Frank explained that while the County Farmland Preservation (FP) Plan was being put together, all the townships were asked to mark on their township zoning maps the property that was located in the Farmland Preservation district but did not practice agriculture. This was to exempt the properties from the Farmland Preservation Act and accurately plot these parcels on the County FP map. The County and Towns’ maps must be consistent. The Town has identified 54 parcels that are not zoned properly and is initiating the rezoning process. Affected property owners were notified via letter of the upcoming rezoning and asked to attend this informational meeting. Now during the state mandated Comprehensive Plan Update, the Town of Lamartine must move forward with the rezoning of these 54 non conforming parcels and correct the Towns’ Zoning Map to be consistent with the County’s Map.
Frank further explained that landowner’s taxes will not be affected by this change in zoning as property is assessed on its use not the zoning. Currently these properties are existing under a conditional use. In the event of a fire, tornado or anything that would destroy the residence the property owner may not be allowed to rebuild. Rezoning this property to the correct zoning would eliminate this issue as well. Frank further explained that the Wisconsin Department of Agriculture Trade and Consumer Protection (DATCP) which administers the States Farmland Preservation Program, has a requirement that the Town’s and the County’s Farmland Preservation maps be consistent. If the Town does not hear from you regarding the rezoning of your property it will be rezoned as is necessary to bring the parcels into compliance, and allow the town to recertify its Farmland Preservation Plan.
Frank showed the Town Zoning map with the parcels identified outlined in pink. He then asked for questions from property owners. Much discussion took place regarding zoning definitions and what did property owners have to do for this rezone. Frank explained that there is nothing else land owners have to do, if the town hears nothing more the rezone will take place.
A meeting date was set for the Public Hearing – Monday, June 3, 2013 at 6:30 PM at the Lamartine Municipal Building Meeting Room. At this time the Plan Commission will hear public comments on this issue and make a recommendation to the Town Board. Letters will be sent to all land owners that did not call or attend this meeting.
With no further business to discuss, Tom moved to adjourn the meeting. Roger seconded the motion. Motion carried and the meeting adjourned.
