RE: Request for a Conditional Use Permit – C&B Ventures, LLC Property
May 7, 2018 6:00 P.M.

Plan Commission Chairman, Jim Reitzner called the meeting to order at 6:00 Pm at the Lamartine Municipal Building Meeting Room. Plan Commission members also in attendance at this meeting were, Dan Wepner, Glenn Becker, Carol Kinyon and David Jacob.
Jill Randall served as the PC Secretary at this meeting.

Hearing notices were confirmed with affidavits for publishing and posting on file.

Jim stated that the purpose of this Public Hearing was to receive public comment and a recommendation from the PC regarding a request received for a Conditional Use Permit (CUP) to remove excess clay off site for wetland and habitat restoration on the C & B Ventures LLC property. This Conditional Use Permit is requested under Section 16 in the Lamartine Zoning Ordinance. The property use is currently for wetland habitat. The current zoning of this property is: Intensive Farmland Preservation (IFP).

A Conditional Use Permit Application was submitted by Gordon Weiss, Project Manager for Mueller Excavating on behalf of the property owner, C&B Ventures LLC. The property is described as follows.
Parcel I.D’s. No. T12-15-16-36-04-001- Involving approximately 20.3 acres located in the SE ¼, Sec.36, Town 15 North, Range 16 East, Town of Lamartine, Fond du Lac County, Wisconsin.
This property is located at W7302 State Road 151, in the Town of Lamartine owned by C & B Ventures, LLC.
The CUP application was found to be complete and all fees were paid.

Chairman Reitzner asked Mr. Weiss to present his request. The purpose of the project is to enhance existing and create additional viable wetland waterfowl and amphibian habitat including ponds. The project will improve and increase wildlife habitat. This project is part of a larger, long-term habitat plan for approx. 204 acres: 184 acres is enrolled in the CRP. The remaining 20.3 acres is the project area with approx. 6.92 acres of existing wetlands. In order to create new wetlands and ponds capable of supporting aquatic life, approximately 200,000 cubic yards of soil will be removed to facilitate the restoration of the project site. Mueller Excavating has received all the necessary state and county permits needed for this project. They are requesting a conditional use permit be granted by the town as hauling excessive clay off the project site is not a permitted use under the Town Zoning Ordinance in this zoning district.

Chairman Reitzner asked if there were any questions or comments in favor or in opposition to the request for a CUP.
The Clerk noted that all adjoining property owner’s had been notified via letter of this public hearing. No phone calls or letters were received by the town regarding this petition.

Reitzner asked if the PC had any further questions or concerns.
Frank Bartzen noted that the town has a Conditional Use Permit document drafted by the town attorney that presents the conditions for which the town will permit this activity.

With no further questions or comments, Carol Kinyon moved seconded by Glenn Becker, that the Plan Commission recommend to the Town Board that this request for a conditional use permit to haul excess soils from this site be granted with the condition that the petitioner signs the Conditional Use Permit document. Chairman Reitzner asked for a voice vote explaining that a yes vote would be to grant the CUP request and a no vote would be to deny the CUP request. Let the record show that five PC members voted (voice votes) with the following results:
Jim Reitzner – YES, Glenn Becker – YES, Dan Wepner – YES, Carol Kinyon -- YES and David Jacob – YES.
Motion carried 5-0 to recommend approval of a Conditional Use Permit as requested.

The Town Board will take action on the Plan Commissions’ recommendation at the regular Town Board meeting; May 14, 2018 at 7:00 Pm at the Lamartine Municipal Building Meeting Room.

With no further business to be considered, Glenn Becker moved to adjourn the public hearing. Dan Wepner seconded the motion. Motion carried 5-0 and the meeting adjourned at 6:20 PM.
