Town of Lamartine Ordinance Review Meeting

Call to Order – Chairman Frank Bartzen called the meeting to order. Also present at this meeting were Supervisors, Roger Grade and Bruce Rhode as well as Clerk, Jill Randall and Treasurer, Greg Michels. Please see sign in attendance sheet (filed with these minutes) for others that attended this meeting. Frank explained the purpose of this meeting was for the board to review and discuss the Town Access Control Ordinance and the Ordinance Regarding Use and Occupancy of Public Rights-of-Way.

Access Control Ordinance – Discussion took place as the Board reviewed the Access Control Ordinance. A summary of the changes follows:

In Section 1.0 two state statues were added as references in the ordinance.
Section 3.0 –Definitions—the Board would like the attorney to review and possibly write a new definition of ACCESS.
Section 5.0—the last sentence was stricken from (F).
Section 6.0—A. Plastic double or dual walled culverts will be allowed. For design standards (See AASHTO M294 or ASTM F-2306). Minimum cover of all culvert will be 12” or more of gravel or other satisfactory material. If slope or grade does not permit minimum standard the minimum coverage will be determined by the Town Road Supervisor. D.—Pavement of driveway access… Much discussion took place about paving of the driveway access and if there should or should not be an exact number of feet to describe the access distance from the TOL roadway to the point ok to start paving with concrete. Frank moved that the distance of 10-feet be added to this ordinance language. Roger seconded the motion. There was a voice vote as follows: Frank YES, Roger YES and Bruce NO. The motion
carried 2-1.
Section 10.0—the following language was added—“Any controversial issues will be directed to the Town Board for review”. The remainder of changes in this ordinance were formatting and language clean up type changes.

Frank stated that the Board would now review the next ordinance; “AN ORDINANCE REGARDING USE AND OCCUPANCY OF PUBLIC RIGHTS-OF-WAY”.
Frank explained that the Town Attorney was recommending that towns consider adopting this ordinance. There are new single post towers that can be set in the right of ways (R/W) without any notice or public hearings; no permission needed from the town to place theses towers unless this ordinance is adopted by the board. The Town Board reviewed this ordinance prior to this meeting and had no changes.

Frank will discuss these ordinances and any changes made by the board with the town attorney. Final copies of these ordinances will then be sent to the board members for a final review to be ready to discuss and take action on at the December 12, 2016 Town Board meeting.

Adjournment—With no further business to discuss, Bruce with a second by Roger moved to adjourn the meeting. Motion carried 3-0. Meeting adjourned at 7:50 Pm.
