Board Meeting Minutes
October 12, 2015
With all notices having been properly posted, Chairman Frank Bartzen called the October meeting to order at the Lamartine Municipal Building Meeting Room (LMBMR) at 7:00 pm. Also present at this meeting was Supervisors; Bruce Rhode and Roger Grade; Clerk; Jill Randall and Treasurer, Greg Michels. Please see meeting sign in sheet for other attendees.
Pledge of allegiance was recited.
Approval of Minutes from Previous Meeting(s)
a. September Board Meeting Minutes (9/14/15) Bruce moved seconded by Roger to approve the August Board Meeting Minutes. Motion carried 3-0.
Treasurer’s Report-Greg read the Treasurer’s report aloud. The ending balance 9/30/2015 is $443,629.38. Motion by Bruce to approve the Treasurer’s report as read, seconded by Frank. Motion passed 3-0.
Concern addressed by town resident as to the Forest Avenue Road ditching issue- the town having learned something from that matter; and inquiry about the “Watercourse Ordinance” on the agenda and what that was all about.
REPORTS & COMMUNICATIONS:
a. Road Report—Frank reported that the last round of mowing is underway.
i. Culvert Permit Report—Lloyd Wallace – A culvert permit for a field entrance on Forest Avenue was issued.
b. Update Veteran – Cemetery Meeting held 9/28/2015—Greg Michels reported that the concrete base of the memorial was resealed, and new lights were put up. There are no new names to be added to the memorial. The town cemeteries continue to deteriorate. The committee would like the board to consider some money for the cemeteries be put in this upcoming year’s budget.
c. Rhode Certified Survey Map (CSM) was signed by Town Chair and Clerk, October 8, 2015.
d. Elected Officials attending WI Towns Assoc. (WTA) Convention; October 25-27, 2015 in WI Dells (Bartzen, Grade, Michels, Randall, Birschbach will all be attending).
e. Budget Workshop – 2016 DRAFT budget will be created by Elected Officials at a budget workshop to be held Monday, October 19, 2015 @ 5:00 Pm at the LMBMR. Town Residents will vote on 2016 budget at November 9, 2015 Town Board Meeting, Budget Hearing & Special Town Meeting beginning at 7:00 Pm at the LMBMR.
f. Update on Board Road Tour – Friday, October 9, 2015 @ 7:30 AM—The road tour to rate the town roads was completed and the ratings were recorded and will be submitted to the DOT as required.
g. Discussion Re: Offer by Town Resident to donate whatever building project the Town may use/need in the Township—The town could use some new posting boards constructed. Frank will check with the individual wishing to complete a project for the town and see if that is something they would be interested in doing.
a. Update /Board Action—Continue Process to Vacate Five (5) Town Gravel Roads: Ballwanz, Darling, Sunnyside, Sunny Drive, Waldson—Frank reported that David Jacob is working on the legal descriptions for the above named town gravel roads. Four of the five should be no problem to give back. Waldson Road needs to be looked into further. The town would give back these gravel roads to the property owner with the understanding that the town will plow them until 4/1/2016, and have them in good condition before returning them.
b. Board Action—Adoption of Water Drainage / Ditch Ordinance—Much discussion took place regarding this ordinance. The Board decided to defer adopting the Water Drainage / Ditch Ordinance until more information, especially the EPAs new rulings could be reviewed and the information studied to know the entire impact this ordinance would have on the town residents.
c. Board Action—Proceed or not with submittal of the TRIP Program Application 2016 – 2017. Frank reported that the TRIP committee has received several applications for the program and was not sure the Board still wanted to move forward with submitting the towns’ application. The Board will submit the 2016 – 2017 TRIP application as planned.
d. Board Action / Update – Forest Avenue Ditch matter – Town Attorney recommendations—Frank read a letter dated October 9, 2015 received by the Town from Attorney Matt Parmentier. In summary the letter gave the town four (4) options to choose from to deal with the Forest Avenue Road ditch matter. #1—Town removes the dirt from the ditch (in front of W7744 Forest Ave Road) with no further action. #2—Town removes the dirt from the ditch and pursues forfeitures against Mr. Woodley. #3—Town removes the dirt form the ditch and places the cost of the work on Mr. Woodley’s tax bill. #4 –Town does nothing with the dirt. (This has been the Towns’ approach in the past). After much debate / discussion; Bruce moved that the Town take that dirt with other dirt and have the Town Road Supervisor put it in the ditch and bring the dirt back up to the level of where the water would rise to the base of the culvert. Motion died due to lack of a second. Frank read the sheriff’s report from the day the dirt was dumped in the ditch and the County Sheriff’s office was called to the scene. The reported stated that Mr. Woodley had ordered the dirt be dumped in the ditch. Roger moved that the Town go ahead and remove the mound of dirt, send a bill to Mr. Woodley and if he does not pay the costs to remove the dirt, the costs are placed on Woodley’s tax bill as a special charge. Frank seconded the motion. Motion carried 2-0 with the vote as follows: Frank and Roger--YES and Bruce—NO.
a. Board Action—Resolution – “Adopting the Fond du Lac County Natural Hazards Mitigation Plan: 2015 – 2016 2020. Bruce move that the Town adopt the Fond du Lac County Natural Hazards Mitigation Plan: 2015 – 2020. Roger seconded the motion. Motion carried 3-0.
b. Board Action—Fire Department Presenting their 2016 Budget—Fire Department President Stan Dietsche presented the 2016 budget. He explained that the fire dept. budget was $44,600 in 2015 and is lowered to $35,100 for 2016. Stan gave a brief report on the fire dept. activities over the last year. He thanked the Town Board for supporting the fire department. The board thanked the fire department for the good service they provide the community and for working so well with the Town Board. Bruce moved seconded by Roger to approve the Lamartine Fire Dept. 2016 budget with many thanks to the fire department. Motion carried 3-0.
c. Board Action—Second coat paving of Thomaswood Trail & Thomaswood Court and the Town taking over these roads—Roger moved that the Town send a letter to SID Investments asking them to complete the Thomaswood Trail and Thomaswood Court road asphalt by putting the final 1.5” of asphalt on and completing the roads shouldering, and the Town will take over the ownership of the two mentioned roads by the 1st of October 2016. Motion was seconded by Bruce. Motion carried 3-0.
d. Board Action—Implements of Husbandry Ordinance (IOH) Adoption for 2016 (This ordinance will supersede the IOH Ordinance R-101314). Bruce seconded by Frank moved that the Town again adopt the IOH Ordinance for 2016, superseding the 2015 #101314 IOH Ordinance. Motion carried 3-0.
Approval of Monthly Vouchers & Checks—Bruce made a motion seconded by Roger to approve the vouchers as presented. Motion carried 3-0.
Adjournment—with no further business to discuss, Roger seconded by Bruce moved to adjourn the meeting. Motion carried 3-0 and the meeting adjourned at 9:05 Pm.
