Board Meeting Minutes
October 13, 2014

With all notices having been properly posted, Frank Bartzen, Chairman called the October meeting to order at the Lamartine Municipal Building Meeting Room (LMBMR) at 7:00 pm. Also present at this meeting were Supervisors; Mike Suprenand and Bruce Rhode, Treasurer; Greg Michels and Clerk; Jill Randall. Please see meeting sign in sheet for other attendees.

Pledge of allegiance was recited.

Approval of Minutes from Previous Meeting(s)—
a. September Board Meeting Minutes (9/8/14)—Mike seconded by Bruce moved to approve the September Board Meeting Minutes as presented. Motion carried 3-0.
b. Special Town Board Meeting Minutes (9/17/14 -Palmer Road Repair & Request to assist w/Ditch Digging)-Mike seconded by Frank moved to approve the 9/17/14 Special Town Board Meeting minutes as presented. Motion carried 3-0.

Treasurer’s Report—Treasurer, Greg Michels read the September Report with an ending balance of: $403,221.46 on
September 30, 2014. Bruce moved seconded by Mike to accept the Treasurer’s report. Motion carried 3-0.

Public Comment:
Concern was addressed regarding recent ditch digging in front of Ed Woodley’s property; inquiring why the ditch was dug so deep.
Concern was also address on grass clippings being dumped on Forest Avenue Road.

a. Road Report—Frank reported that 800 to 900-feet of Palmer Road was accidentally moved over (+/-) 1 ½ to 2 feet by Northeast Asphalt (NEA) during the recent pavement of the road. Please see iii below for more about this subject.
i. Culvert Permit Report—NONE this past month.
ii. Road Work Update per Frank—Frank read two letters the town received complimenting Rich and his crew for keeping the roads in such great shape this past winter. Frank reported that Rich has been mowing the roadsides.
iii. Sept. 17th Special Town Board Mtg -- Palmer Road Repair & Request to assist w/Ditch Digging-- Frank explained that after Palmer Road was resurfaced some road damaged was noticed on the road. He spoke with Northeast Asphalt (NEA) about this damage and it was discovered that somehow during resurfacing of the road 800 to 900-feet of Palmer Road was accidentally moved over (+/-) two feet. NEA gave the board two options to repair Palmer Road and correct this mistake. The board at the special board meeting held on 9/17/14 voted to accept the option by NEA to grind the entire section of Palmer Road and move the road over approximately 2 feet. The work is now done and is ready to have the county come and do the shouldering. NEA did a great job of taking care of this problem. This was a TRIP project.
Frank also reported that another order of business at this Special Town Board meeting on Sept 17th was to hear a request for the town to assist with the cleaning of the ditch on Forest Avenue Road (Woodley Property) by Larry Conger. Larry asked if the town would help with a truck and man to haul dirt and also assist in flagging traffic while excavation is taking place. Frank reported that the board after much discussion voted 2 to 1 that the town would have a truck available to haul dirt if the town needs it for town purposes, and the town employee would not help in flagging and have no other participation with the project. Frank noted that the town did not end up hauling any dirt from this project as the town did not currently have a need for the dirt. Much discussion ensued regarding the ditch being dug too deep causing the water pool in the ditch. The ditch was dug up to Woodley’s culvert. The culvert was not excavated as was discussed at a previous meeting with Mr. Woodley. Larry stated that Mr. Woodley decided to not participate in this ditching project. Supervisor, Mike Suprenand stated that he was not going to have anyone talking down about the excavator, Mr. Woodley or David Jacobs (surveyor) as these individuals were not present to defend themselves. Frank said the meeting would now move on to the next agenda item.
iv. Tree Removal on Town Roads—No decision was made, Frank will speak with property owners where these trees are located.
b. Update on Voskuil property—Some time ago the town sent out a letter informing Ms. Voskuil that her property must be cleaned up by November 1. Frank will keep trying to get a hold of her to see how it is going.
c. ELECTION –November 4, 2014 General Election—Polls Open 7:00 Am to 8:00 Pm—Announcement made regarding election and Voters NO LONGER NEED TO PROVIDE A PHOTO ID TO VOTE!!
d. Update on Small Claims Court filing for Ron Semenas’ Delinquent Personal Property Taxes 2011, 2012 & 2013—The first court date the Town and Semenas were sent to mediation. More information was needed from the town assessors and another court date has been set for November 7th.
e. Budget Workshop – October 20, 2014 at 5:15 PM—For Elected Officials. Town Residents will vote on 2015 Budget at November 10, 2014 Town Board Meeting, Budget Hearing & Special Town Mtg at 7:00 Pm at the LMBMR. This announcement was read aloud.
f. Annual WI Towns Association Convention – October 26 – 28, 2014 at Stevens Point—Chairman, Treasurer, Constable and Clerk to Attend. This announcement was read aloud.
g. Update on Cemetery / Veteran Memorial Committee Meeting—Held Sept. 23, 2014 –Greg reported that there were no new names to add to the memorial. The flags are getting weathered but, they will try to hold off until spring to replace them. The committee discussed getting permission to put a notice in the local papers asking if anyone has any information on the Anderson Cemetery. The Town received no cemetery records when it inherited the care of the cemetery. The board felt it was a good idea to get the word out requesting knowledge of any records available. A suggestion was also made to put this notice out on different social media. Greg further reported that there was a skinny tree on the south side of the cemetery that needs to come down. Frank stated that Rich will take that tree down.
a. Mt Pleasant Drive Vacation—PUBLIC HEARING—Nov. 6, 2014 @ 6:30 PM at the LMBMR—Frank announced the Public Hearing for the Vacating of Mt. Pleasant Drive will be held as described above.
b. Update on “Little Free Library” located in LMBMR parking lot (constructed and donated by Dan & Cindy Pucker)—Frank announced that the Little Free Library is in place and ready for people to utilize. Frank extended a big thank you to Dan & Cindy for their donation. Cindy will be maintaining the library.

a. Board Action—Adoption of Ordinance to Opt-In for Category B RE: Implements of Husbandry (IOH) Pursuant to Sec. 348.15(3)(g)—Frank read the ordinance aloud. Mike moved to adopt the Ordinance to Opt-In for Category B for Implements of Husbandry; Ordinance #R-101314. Bruce seconded the motion. Motion carried unanimously 3-0.
b. Board Action—Adoption of Shoreland Zoning Agreement RE: Farmland Preservation Tax Credits—Frank explained that if the town does not adopt this Shoreland Zoning Agreement the farmers in the township will miss out on (+/-) $27,000 in tax credits that they currently are collecting on land that is in a shoreland zoning district. This ordinance which is good until the end of 2015 will give state legislatures time to fix the problem. Mike seconded by Frank moved to approve the Shoreland Zoning Agreement with Fond du Lac County to allow town residents to continue to collect farmland tax credits in these areas of the township. Motion carried 3-0.
c. Fire Department Presenting 2015 Fire Department Budget—Fire Department President, Stan Dietsche and Fire Department Chief, Joe Birschbach presented the 2015 Fire Dept. budget. The total contracted amount is $44,600. Frank explained that the board would use the fire dept. budget amount on the planning budget for the budget workshop on Oct. 20th. The board will be putting together the numbers for the 2015 town budget. The Town Residents will vote on the 2015 budget at the Special Town Board meeting on November 10, 2014.
d. Board Action—Operator License for Logan Kinyon (Halfway House)—The clerk reported that there was no criminal background report for Logan Kinyon. Mike seconded by Bruce moved to approve the issuing of an operator’s license to Logan Kinyon. Motion carried 3-0.
e. Road Supervisor Review of Evaluation and Wage / Benefit discussion—The Town Board intends to enter into closed session pursuant to Wis. Stat. 19.85(1) (g) for the purpose of considering employment, promotion, compensation, or performance evaluation data of any public employee over which the Town has jurisdiction or exercises responsibility. In the closed session, the Town Board will consider the employment, promotion, compensation, or performance evaluation of the Town’s Road Supervisor. (Roll Call is required) Frank read the above intent of the board to go into closed session to discuss the Road Supervisor’s work performance and compensation. Bruce moved seconded by Mike that the Town Board go into closed session pursuant to Wis. Stat. 19.85(1) (g). Let the record show the following roll call vote; Mike—YES, Bruce—YES and Frank—YES. Motion carried 3-0 to approve moving into closed session. Frank asked those in attendance to please leave stating that they could return after the closed session. When discussion regarding Road Supervisor’s work performance and compensation concluded, Mike moved seconded by Bruce to adjourn closed session and move back into open session. Motion carried 3-0 and open session reconvened. Mike moved seconded by Frank to keep Rich’s health insurance allowance at $900.00 per month and increase his pay rate $.35 cents per hour beginning January 1, 2015. Motion carried 3-0.

Approval of Monthly Vouchers & Checks—Bruce made a motion that the board approve the checks and vouchers as presented. Mike seconded the motion. Motion carried 3-0.

Adjournment—Mike seconded by Frank moved to adjourn the meeting. Motion carried 3-0 and the meeting adjourned at 9:15 Pm.
