TOWN OF LAMARTINE
Monthly Town Board Meeting
Minutes Dated: September 13, 2010

With all notices having been properly posted, Frank Bartzen, Chairman called the September Board Meeting to order at the Lamartine Municipal Building Meeting Room at 7:30 Pm.

Supervisor Mike Suprenand, Supervisor Bruce Rhode, Clerk Jill Randall and Treasurer Greg Michels were also in attendance at this meeting.

The Pledge of Allegiance was recited.

Frank called for any corrections or additions in the August Board Meeting minutes.
Bruce made a motion to accept the August Board meeting minutes as presented. Frank seconded the motion. Motion carried 2-0. Mike did not vote because he was not at the August meeting.

Frank asked Greg to read the August Treasurer’s report. The ending balance as of 8-31-10 is $538,826.36. Bruce seconded by Mike moved to accept the Treasurer’s report as given. Motion carried 3-0.

Citizen Concerns: A concern citizen inquired as to why the November 2009 minutes were not on the Town website. The clerk explained that if the minutes are not posted to the website it was an oversight and they would be posted to the website as soon as possible. The clerk also noted that websites are not recognized as legal posting sites and notices, minutes and other town business is only posted to the website as another way of keeping town residents informed and is not a mandatory posting. Discussion took place regarding how corrections in the minutes are recorded.
Dennis Schmitz - N6590 Townline Road and Robert Sanok - N6604 Townline Road asked to speak regarding the culvert installation on Townline Road. They felt that the culvert was not installed properly and were concerned that proper drainage may not occur during heavy rainfall events. They distributed pictures for the board to review. Frank stated that about two weeks ago he had grades shot on this culvert elevation and was told the elevation was okay. Mike suggested that the Lamartine Town Board and Road Supervisor Rich Buteyn meet Tuesday—September 21, 2010 at 5:00 Pm for an onsite meeting at N6590 Townline Road (Dennis Schmitz Property) and N6604 Townline Road (Robert Sanok Property) to view and discuss the issue so it can be resolved. The Board will not make any decisions at the time of this meeting.

Fisher Request for Conditional Use Permit (CUP): Board Discussion / decision on Plan Commission (PC) recommendation regarding a request for a CUP from Ed Fisher (Steinke) to create a two (2) acre non-farm parcel in the Moderate Farmland Preservation Zone. Plan Commission Chairman, Jim Reitzner reported that the PC held a public hearing at 6:30 Pm this same evening to hear the CUP request. The PC voted 5-0 to recommend to the Town Board that this CUP request be granted. Discussion took place. Mike made a motion that the Board accept the PC recommendation and grant the Conditional Use Permit. Frank seconded the motion. Frank called for a paper ballot vote explaining that a YES vote would mean that the CUP would be granted and a NO vote would mean the CUP would be denied. Let the record show that three (3) votes were cast with the following results: Frank Bartzen—YES, Mike Suprenand—YES, Bruce Rhode—YES. The Board vote 3-0 to approve a Conditional Use Permit to create a two (2) acre non-farm parcel in the Moderate Farmland Preservation Zone to Ed Fisher. These two (2) acres of land are located east adjacent to W8055 Brown Road in the Town of Lamartine. More particularly described as: That part of the Southwest ¼ of the Southwest ¼ of said Section 23; T.15 N.-R. 16 E., Town of Lamartine, Fond du Lac County.
Mike seconded by Bruce made a motion to destroy the ballots. Motion carried 3-0.

REPORTS AND COMMUNICATIONS:
A. Road Report—Rich reported that he has been working on road shouldering and grounds mowing. Frank reported that the Town road mileage has been submitted to the DOT.
1. Weight Limit Posting for Town Roads—Frank explained that after the August Board meeting he researched the possibility of the town putting up signs on selected town roads that read “NO TRUCK TRAFFIC”. This is not recommended as it is very difficult to enforce. They recommend that the roads be posted with weight limits of 10 Ton or 60% of their licensed weight. This type of posting would not limit fuel, fertilizer or milk trucks from traveling on the posted roads as long as they are going from point A to point B to and from their destination. The Town can post the roads anytime regardless of the time of year. Much discussion took place regarding posting the roads; the benefits and concern that farmers not be hindered due to the postings. Mike made a motion to post Palmer Road and Lincoln Road to Class B to start and then assess how it is working. Clarification was requested from the audience on exactly how this weight limit posting would affect the farm traffic. Mike withdrew his motion. The Board will research how the weight limit posting will affect farm harvesting traffic and resume this discussion at the October Town Board meeting (10/13/10).
2. Rogersville-Schmidt Property landscaping—Bruce inquired as to why this landscaping was not done as the Town intended that work would be done completely. An estimate was received to complete this work for around $1400.00. The Schmidt’s were happy with this landscape plan. Mike made a motion to have the landscaping done using this bid, and to contact the church (St Stephens) to pay half as this was the original arrangement on this culvert project between the Town and the church. Bruce seconded the motion. Motion carried 3-0. Bruce will contact Mr. Ott from the church to see about paying half the cost. Bruce thanked Frank for his hard work on this matter.
B. Update on the Veterans Memorial / Cemetery Committee Meeting held August 23, 2010—Greg reported that there was no business to discuss regarding the memorial other than possibly putting an edge around the berm. This will be looked into further. Cemetery issues were talked about. The fence line needs to be sprayed with weed killer so they can work there when they have time. Final arrangements were made for Community Day to be held on Saturday, September 25th from 11:00 Am until 4:00 Pm. The parade will begin at 11:00 Am on Haberkorn Drive and traveling West through Lamartine to the Lamartine Cemetery on Lincoln Road. After the parade there will be more family fun activities at the Lamartine Municipal Building and Fire Station. Enjoy musical entertainment, fire station tours and see the flight for life helicopter! Food and beverages will be for sale.

NEW BUSINESS:
A. Discussion / decision setting Budget Workshop meeting dates—The Board will meet to plan the 2011 budget on Monday, October 18, 2010 at 5:30 Pm. The budget will only be planned at this meeting. The 2011 budget will be presented to the public at a Budget Hearing on November 8, 2010 at 8:00 Pm followed by a Special Town Meeting where the town electors approve the budget and town levy.
B. Approval to issue Brian Michels an operator’s license—Mike made a motion seconded by Frank to approve the issuing of an operators license to Brian Michels. Motion carried 3-0.
C. Discussion / decision regarding a re-assessment of the township—Frank offered a bid prepared by Bowmar Appraisal Specialist. The amount of the bid seemed very reasonable considering prices the Town has heard for complete township assessments in the past. Mike made a motion to put out a request for bids for a complete property assessment of the township to be completed in 2012. Frank seconded the motion. Motion carried 2-1. The vote was as follows: Frank—YES, Mike—Yes and Bruce—NO. Greg will speak to the Town Assessors regarding this matter.
D. Discussion / decision regarding project bidding policy—Discussion took place regarding the town adopting a policy for bidding out work projects. Frank distributed an article from the Wisconsin Towns Association entitled: “Bidding: when it is and is not required” for the Board to review. The Board will discuss this issue in further detail at the November Town Board meeting (11/8/2010 @ 7:30 Pm).

Approving the monthly vouchers and checks—Mike made a motion seconded by Bruce to approve the vouchers and checks presented at this meeting and to grant permission to pay the officer hired for Community Day if the contract requires payment before the next board meeting. Motion carried 3-0.

Adjournment—Mike moved seconded by Bruce to adjourn the meeting. Motion carried 3-0 and the meeting adjourned at 9:40 Pm.
