Request for a Conditional Use Permit
Petitioner: Jacob Land Surveying, LLC on behalf of Edward Fisher
September 13, 2010
The Clerk made introductions.
Plan Commission (PC) Chairman Jim Reitzner called the meeting to order, noting that this hearing would be informal. Also present at this meeting were the remainder of the PC members; Dean Birschbach, Tom Kramer, Roger Grade and Glenn Becker, Clerk Jill Randall and petitioner, David Jacob (Jacob Land Surveying) on behalf of Edward Fisher and Aaron and Michelle Steinke.
The property is owned by Edward Fisher and is located east adjacent to W8055 Brown Road in the Town of Lamartine. More particularly described as:
That part of the Southwest ¼ of the Southwest ¼ of said Section 23; T.15 N.-R. 16 E., Town of Lamartine, Fond du Lac County.
The Clerk read the letter of intent. The letter dated August 19, 2010 from Jacob Land Surveying, LLC, requested a conditional use permit (CUP) on the above referenced property owned by Fisher to create a residential lot on a two (2) acre parcel of land in an agricultural zoning district. The Town Board has conditionally approved the certified survey map provided a conditional use permit is granted. The purpose of the CUP is to create a 2.000 acre lot (after road dedication) for the purpose of building a residence for Aaron and Michelle Steinke. Aaron will be working full time on the Fisher farm next year as a partner with Edward Fisher.
Jim asked if the petitioner had any further comments, concerns or additions. David Jacob explained that originally they had considered rezoning this property but decided that it made more sense under the newly adopted Town of Lamartine Zoning Ordinance to request a CUP. Mr. Steinke has no ownership in the farm at this time.
Chairman Reitzner asked if any letters of opinions were received regarding this rezoning. There were no letters of opinions offered from Fond du Lac County Planner Sam Tobias or Town Building Permit Issuer, Pete Michels.
Discussion took place regarding this request for a CUP. PC member Tom Kramer noted that if this was a year from now (Steinke was already in a partnership with Fisher) this meeting would not be necessary. Frank Bartzen asked about a berm on the property and if it would be lowered so there was no future problem with the vision triangle. Mr. Steinke stated that the berm would be lowered so there is clear vision.
Dean Birschbach made a motion to recommend to the Town Board that they approve the granting of a conditional use permit. Glenn Becker seconded the motion. Let the record show that five votes were cast with the following results: Jim—YES, Roger—YES, Tom—YES, Dean—YES, and Glenn—YES. Motion carried 5-0. The Plan Commission will recommend a conditional use permit to create a two (2) acre non-farm parcel in the Moderate Farmland Preservation Zone be granted to Edward Fisher.
Tom Kramer seconded by Roger Grade made a motion to adjourn the meeting. Motion carried 5-0. Meeting adjourned at 7:00 Pm.
The Town Board will take action on this CUP request this same evening at the (September 13, 2010) Town Board meeting at 7:30 PM at the Lamartine Municipal Building Meeting Room.
