Variance requests were made for the property located at W8139 & W8147 CTH Y, in the Town of Lamartine, Fond du Lac County, more particularly described as:

S34 T15N R16E Plat of Village of 7 Mile Creek (V1141-463 & V1260-573)

And part of S34 T15N R16E Plat of Village of 7 Mile Creek W 110’ Lot 13 (V1141-463 & V1260-573) and S34 T15N R16E Plat of Village of 7 Mile Creek Lot 14 (V1141-463 & V1260-573 860378)

The Clerk made introductions.

The following members on the Town of Lamartine Board of Appeals were present at this meeting—Chairman Greg Michels, J. Peter Braun, Roger Searl, Harold (Bud) Guenther and Randy Kuik.

Also present at this meeting were petitioners Scot & Cheryl Fischer and their soil tester Bernie Ritger.

With notices having been properly posted and published Chairman Greg Michels called the meeting to order.

The Clerk read the letter of intent. The letter stated that the Fischer’s were considering the purchase of a house and adjacent empty lot from Mrs. Fischer’s sister, Lori Suprenand. The house they would be purchasing is located at W8139 CTH Y. They would like to purchase the house and land and eventually tear down the old green house and build a new home. To be able to do this they would have to be granted the following variance requests.

1. Request for a variance in the minimum lot size of a residential lot from one acre to .75 acre.

2. Request for a variance in the minimum set back from the highway from 100 feet to 50 feet.

3. Request for a variance in the minimum lot size of a business lot from one acre to .69 acre.

The letter further stated that the township has many lots that are smaller than an acre and homes that are much closer to the road than 100 feet therefore the granting of these variances would be suited to this area. The purchase of this property is pending on the granting of these variances, and the granting of a rezoning request for a portion of this property.



Chairman Michels asked the petitioner if there were any additional comments to add to the letter of intent. The petitioners had nothing to add.



Chairman Michels asked if there were any comments regarding the variance requests from Town Building Permit Issuer Pete Michels or County Planner Sam Tobias. No opinions were offered from Pete Michels. The clerk read an email from Tobias dated August 16, 2006. Mr. Tobias recapped the property layout, acreage and zoning of each parcel of land involved in these requests. He stated that the road setback seemed easy. The hardship in this case is the mound system for the bar being located in the rear portion of the lot forces the new home closer to the road. Averaging road setbacks is fairly common. He also stated that if the house east of the shop was going to be removed and a new house built soon, he’d recommend going with the



lot size variance as well. He further stated that if the petitioner does as he plans, removing the old home and building a new place further east away from the shop and bar would be good for the area. A lot size variance for the bar and shop lot would make sense for the same reason.



Discussion took place regarding these variance requests. The mound system at the back of the vacant lot which services the bar would be sold with the property and the two parties (Fischer and Suprenand) would draw up and record an easement so Suprenand could continue to use the mound system. The Board of Appeals recommended that an easement be drawn up between the parties in the future. Fischer’s hope to build a new home on this site in 4-5 years.



Roger Searl made a motion to grant the three variance requests (as listed below) not to exceed the minimum lot sizes or set backs requested by the petitioners and that the granting of these variances is contingent on the property being rezoned and the sale of the property taking place. Bud Guenther seconded the motion.

1. Request for a variance in the minimum lot size of a residential lot from one acre to .75 acre.

2. Request for a variance in the minimum set back from the highway from 100 feet to 50 feet.

3. Request for a variance in the minimum lot size of a business lot from one acre to .69 acre.

Chairman Michels explained that a YES vote would mean that the variances would be granted and a NO vote would mean the variances would NOT be granted.



Let the record show that 5 paper ballots were cast with the following results: YES—5 votes and NO—0 votes. The Board of Appeals voted unanimously to grant all three of the above listed variance requests.



Roger Searl seconded by Pete Braun made a motion to destroy the ballots. Motion carried 5-0.



With no further business to discuss, Bud Guenther made a motion to adjourn the meeting. Roger Searl seconded the motion. Motion carried 5-0.
