RE: Request for a Conditional Use Permit – James Zimmerman /Guy Stewart – Central State Towers
September 8, 2014 6:00 P.M.

Plan Commission (PC) Chairman Jim Reitzner called the meeting to order at 6:00 Pm at the Lamartine Municipal Building Meeting Room. PC members also in attendance at this meeting were, Tom Kramer, Roger Grade, Carol Kinyon and Marvin Bosveld. Jill Randall served as the PC Secretary at this meeting. Hearing notices were confirmed with affidavits for publishing and posting on file.
Jim stated that the purpose of this Public Hearing was to receive public comment and a recommendation from the PC regarding a request received for a Conditional Use Permit (CUP) to construct a 260-foot Mobile Cell tower on approximately .25 acre of land east of Hageman Road in the Town of Lamartine. This land is currently zoned Moderate Farmland Preservation. The current land use is farmland and woods.

The PC Secretary read the Conditional Use Permit Application submitted by Guy Stewart of Central State Towers (Verizon Wireless) on behalf of the property owner: James Zimmerman (W10634 State Road 23, Rosendale, WI. The location of the petitioned Conditional Use is east of Hageman Road in the Town of Lamartine, Fond du Lac County, Wisconsin. More particularly described as:
A part of the West ½ of the Northwest ¼, Section 11, T. 15N.-R. 16E. Town of Lamartine, Fond du Lac County, Wisconsin. Parcel Number: T12-15-16-11-07-001-00.
The CUP was requested to allow construction of a 260-foot mobile cell tower. The CUP application was found to be complete by the Town Attorney and all fees due at the time the Conditional Use Permit Application is filed are paid in full.

Chairman Reitzner asked Mr. Stewart if he had any other information or comments to add. Stewart explained that Verizon Wireless needs an antenna in this part of the township. Zimmerman’s have agreed to support the tower in a mutually agreed upon spot in their farm field. The tower site and the route to get to the site tower is set along the edge of the field and the site for the tower is on the edge of the wooded area to minimize the use of farmland for this project.

Chairman Reitzner asked if there were any comments in favor or in opposition to the request for a CUP. Reitzner commented that the PC received a very nice package from Central State Towers. Clerk, Jill Randall commented that two phone calls were received by the town asking what was happening with this property, but, received no comments from the callers in favor or against the CUP request. Town Chairman Frank Bartzen agreed that Central State Towers put together a nice package for the town and the PC to review. He also informed the PC that the tower would be located (+/-) 1300-feet off from Hageman Road. The Lamartine Fire Department (LFD) requires a turnout lane on all driveways 500-feet or more. The LFD issued a letter to the town stating that the turnout requirement has been waived. Stewart further stated that after the initial construction there would be no heavy equipment using the roads, only a vehicle approximately three times per month to check on their equipment. Other questions / concerns were addressed regarding wetlands and that all requirements must be met before the tower is constructed. A long term agreement has been established with the Zimmerman’s. If the tower is abandoned there is a requirement per ordinance and a bond the town will have with the cell tower company to assure that the tower is removed.

Chairman Reitzner referenced a letter dated August 20, 2014 and “Outline of Conditional Use Permit” the town received from the Town Attorney Matt Parmentier. The outline was reviewed and PC discussion took place.

With no further questions or comments, Carol Kinyon moved that the Plan Commission recommends to the Town Board to grant a Conditional Use Permit to James Zimmerman / Central States Tower to erect a 260-foot mobile cell tower on property located on Hageman Road in the Town of Lamartine; with the condition that all CUP Outline items as submitted by the Town Attorney’s office, dated August 20, 2014 are addressed to the Towns’ satisfaction and all legal fees related to this project are the responsibility of petitioner. Roger Grade seconded the motion.



Chairman Reitzner asked for a voice vote explaining that a yes vote would be to grant the CUP request and a no vote would be to deny the CUP request. Let the record show that five PC members voted (voice votes) with the following results:
Jim Reitzner – YES, Tom Kramer – YES, Roger Grade – YES, Carol Kinyon – YES and Marvin Bosveld – YES.
Motion carried 5-0 to recommend approval of a Conditional Use Permit for the erection of a mobile cell tower as described above. See Attachment “A” Outline of Conditional Use Permit.

With no further business, Marvin Bosveld seconded by Tom Kramer moved to adjourn the public hearing. Motion carried 5-0 and the meeting adjourned at 6:30 PM.
