RE: Request for a Conditional Use Permit – MASER PROPERTY
September 9, 2019 6:00 P.M.
Lamartine Municipal Building Meeting Room (LMBMR)

Plan Commission Acting Chairman, Carol Kinyon called the meeting to order at 6:00 Pm at the Lamartine Municipal Building Meeting Room. Plan Commission members also in attendance at this meeting were, Dan Wepner, Glenn Becker, Katie Deaver and David Jacob.
Jill Randall served as the PC Secretary at this meeting.

Hearing notices were confirmed with affidavits for publishing and posting on file.

Carol stated that the purpose of this Public Hearing was to receive public comment and a recommendation from the PC regarding a request received for a Conditional Use Permit (CUP) for the creation of a non-farm residences by CUP without the need to rezone This Conditional Use Permit is requested under sec. 7.4 (A)(1) “Nonfarm residences that qualify under Wis. Stat. Ch. 91.46 (1) (d) and defined in Section 3.2 built after January 1, 2014”. The Town Zoning Ordinance allows this to be done by CUP without the need to rezone.

A Conditional Use Permit Application was submitted by property owner(s) Troy & Carrie Maser. The property is described as follows.

Parcel I.D’s. No. T12-15-16-14-07-005-00. Approximately thirteen (13) acres on Hillcrest Road, currently zoned Moderate Farmland. Located in part of the SW ¼ of the NW ¼, Sec.14, Town 15 North, Range 16 East, Town of Lamartine, Fond du Lac County, Wisconsin.

The CUP application was found to be complete and all fees were paid.

Chairman Kinyon asked Mr. & Mrs. Maser to present their request. Mrs. (Carrie) Maser stated that they had purchased 13.37 acres of land on Hillcrest Road to build a single family, four-bedroom, 2.5 bath home with a detached garage on this property. They have no intention of farming the property or building any other buildings on the property at this time.

Chairman Kinyon asked if there were any questions or comments in favor or in opposition to the request for a CUP. The Clerk noted that all adjoining property owners had been notified via letter of this public hearing. No phone calls or letters were received by the town regarding this petition. Carol Kinyon stated that she had spoken with one of the neighboring property owners and they did not have a problem with this home being built here. Lisa Collien, N6267 Hillcrest Road (neighbor) stated that she does not oppose this CUP being granted she just was voicing a concern regarding the driveway elevation. Robert Kraus, N6819 Giebel Road, stated he was in-favor of the CUP being granted. Kinyon asked if the PC had any further questions or concerns.

With no further questions or comments, David Jacob moved seconded by Glenn Becker, that the Plan Commission recommend to the Town Board that this request for a conditional use permit to construct a non-farm residence by CUP without the need to rezone be granted; with the condition that only one single non-farm residence is allowed on this property. Chairman Kinyon asked for a voice vote explaining that a yes vote would be to grant the CUP request and a no vote would be to deny the CUP request. Let the record show that five PC members voted (voice votes) with the following results:
Carol Kinyon – YES, Glenn Becker – YES, Dan Wepner – YES, Katie Deaver -- YES and David Jacob – YES.
Motion carried 5-0 to recommend approval of a Conditional Use Permit as requested.

The Town Board will take action on the Plan Commissions’ recommendation at the regular Town Board meeting this same evening; September 9, 2019 at 7:00 Pm at the Lamartine Municipal Building Meeting Room.

With no further business to be considered, David Jacob moved to adjourn the public hearing. Katie Deaver seconded the motion. Motion carried 5-0 and the meeting adjourned at 6:30 PM.
