Board Meeting Minutes
September 9, 2019
With all notices having been properly posted, Frank Bartzen, Chairman called the September meeting to order at the Lamartine Municipal Building Meeting Room (LMBMR) at 7:00 pm. Also present at this meeting were Supervisors; Randy Kuik and Travis Kloetzke, Treasurer Greg Michels and Clerk; Jill Randall. Please see meeting sign in sheet for other attendees.
Pledge of allegiance was recited.
Approval of Minutes from Previous Meeting(s)
August Board Meeting Minutes (8/12/2019) –Randy moved seconded by Travis to approve the August Town Board meeting minutes as presented. Motion carried 3-0.
Treasurer’s Report – Greg read the August Treasurer’s report aloud. The ending balance as of 8/31/2019 was
$ 548,300.88. Randy move to accept the Treasurer’s report as given. Motion seconded by Frank. Motion carried 3-0.
CONDITIONAL USE PERMIT (CUP) REQUEST - Board Action on Recommendation from Town Plan Commission on the Maser Conditional Use Permit (CUP) request to build a “nonfarm residence on property zoned Moderate Farmland”.
This Conditional Use Permit is requested under sec. 7.4 (A)(1) “Nonfarm residences that qualify under Wis. Stat. Ch. 91.46 (1) (d) and defined in Section 3.2 built after January 1, 2014”. The Town Zoning Ordinance allows this to be done by CUP without the need to rezone. A Conditional Use Permit application was submitted by property owner(s) Troy & Carrie Maser. The property is described as follows: Parcel I.D. No. T12-15-16-14-07-005-00. Approximately 13.37 acres on Hillcrest Road, Located in part of the SW ¼ of the NW ¼, Sec.14, Town 15 North, Range 16 East, Town of Lamartine, Fond du Lac County, Wisconsin. Acting Plan Commission (PC) Chairman, Carol Kinyon reported to the town board that earlier this same evening, the PC held a public hearing on the Maser CUP request. The Town PC voted 5—0 to recommend the town board grant the CUP to construct a non-farm residence by CUP without the need to rezone, with the condition that only one single non-farm residence is allowed on this property. Frank moved that the town board accepts the recommendation of the PC and grants the Maser’s a conditional use permit to construct a “nonfarm residence on property zoned Moderate Farmland” without the need to rezone, with the one condition that only one single family home be allowed on this 13.37 acres of land. Travis seconded the motion. The voice vote results were as follows: Frank—YES, Travis—YES and Randy—YES. The Town Board voted 3-0 to grant a conditional use permit as stated above to Troy & Carrie Maser. REPORTS & COMMUNICATIONS
a. Road Report -- Justin reported that he has been working on chipping up brush and trees around the township. Roads that were previously selected have been crack filled. The road damage done by big trucks during construction on the Cody Birschbach property will be repaired soon. The Oshkosh truck is being readied to go up for sale.
i. Culvert Permit Report—Frank read the culvert permits issued this past month.
ii. Hwy 23 Closure -- State Highway 23 was closed today for the next 35 or so days for reconstruction from Rolling Meadows Drive in Fond du Lac west to Townline Road. The town posted Forest Ave and Fisher Road with 10-ton weight limits to keep the truck traffic off these roads during Hwy 23 construction.
b. Monthly Building Permit Report – Frank read the building permits issued in July & August aloud.
c. Update on Pinno Drive – Preliminary Report of Engineering Costs - Frank reported that he had a preliminary proposal for engineering costs from JE Arthur & Associates for engineering the reconstruction of Pinno Road in the amount of $7,100. Estimates on the cost of the actual labor and materials for this project will need to be researched as well. Much discussion took place regarding the drainage problems in the township, and if any progress has been made in getting the landowners to clean out the creek and ditches in the areas they own to help get the water moving through like it should. Janet Waldschmidt reported that she has hired an engineering firm to help her get a permit to do some of the clean outwork.
d. Budget Workshop Meeting (Town Elected Officials) Tuesday, October 22, 2019 @ 6:00 PM to prepare 2020 budget to be presented at the Budget Hearing & Special Town Meeting Nov. 11, 2019
e. WTA Convention will be held on October 13 – 15, 2019 in WI Dells. A number of Town Officials will be attending.
f. ANNOUNCEMENT / REMINDER: October Town Board Meeting is moved to the first Monday (Oct 7, 2019) due to the town officials attending the Annual WTA Convention the second Monday in October. November town board meeting will be back on the second Monday as always (Nov. 11, 2019)
g. Update on Town Attorney Advised Ordinance “Ability to Regulate Short Term Rental Properties (Airbnb & VRBO). Matt Parmentier, the town attorney, is working on this ordinance with several towns. The town will likely adopt this ordinance when it is completed.
a. Board Action to adopt Amended Sex Offender Ordinance – Travis seconded by Randy moved to adopt the Amended Sex Offender Ordinance. Motion carried unanimously 3-0.
a. Board Action – Acceptance of Thomaswood Trail & Thomaswood Court roads to township road inventory- Frank stated that these roads are done and Woodland Estates has met their obligation and the monies can be released. Randy seconded by Travis moved to accept Thomaswood Trail and Thomaswood Court into the town road inventory. Motion carried 3-0. Road aides will not be received for these roads until 2021.
b. Board Action – Bid to Remove one dead tree at North Lamartine Cemetery – A quote was received from Torres Tree Service for $800 - $950. This quote for North Lamartine Cemetery to remove one tree, stump and reseed. Travis seconded by Frank moved to accept this quote. Motion carried 3-0.
c. Board Action – Relocation of fence placed in Town of Lamartine right of way along Pinno Drive – Frank explained that while surveying the Pinno Road right of way it was discovered that part of the Waldschmidt fence is on town property. After much discussion it was decided that Waldschmidt will speak to their attorney about this fence and they will work with the town attorney about this matter.
d. Discussion / decision regarding possible increase (7 - 10%) in the Town Levy Limit for 2019 payable 2020. Frank asked the board to think about a possible increase in the town levy for next year. We will get our numbers together and see if a levy limit increase is needed. The cost of gas, fuel, sand, salt and road construction just to name a few items, keep going up and we are held to the levy limits each year. This item will be tabled to the October board meeting.
Approval of Monthly Vouchers & Checks— Frank moved seconded by Randy to approve the vouchers for future payment as soon as the checks can be printed from the town hall software program. Motion carried 3-0.
Adjournment –Randy seconded by Travis moved to adjourn the meeting. Motion carried 3-0, meeting adjourned at 8:15 PM.
