Rezoning request of 15.791 Acres of Land from Exclusive Agricultural to Residential

SE ¼ of the SW ¼ of Section 11 T15N R16E in the Town of Lamartine, Fond du Lac County, Wisconsin. The property is about a quarter mile South of Highway 23 on the East side of Fisher Road at the end of Treptow Lane. This parcel is Outlot 1 of Hickory Heights, the remaining land East of the existing development.
Larry and Debbie Conger, W7902 Forest Avenue Road, Fond du Lac, WI in the Town of Lamartine own this property.
The Clerk made introductions.
Present at this meeting were Jim Reitzner, Glenn Becker, Dean Birschbach, Randy Abitz and Tom Kramer. Glenn Becker served as an alternate for Roger Grade.
With all notices having been properly published and posted, Chairman Reitzner called the meeting to order.
The Clerk read the letter of intent. The letter dated July 13, 2004 sent on behalf of the Congers to the Town of Lamartine by David Jacob of Excel Engineering Inc. stated that Larry Conger was requesting to have 15.791 acres of land rezoned from Exclusive Agricultural to Residential. The letter further stated the 15.791 acres of land requested to be rezoned was located about a quarter mile south of Highway 23 on the East side of Fisher Road at the end of Treptow Lane and is Outlot 1 of Hickory Heights a development that Mr. Conger has already began. Mr. Conger was asking for this rezoning to finish out the extension of Treptow Lane southerly to Forest Avenue Road and create 8 residential home sites fronting on both sides of this road. The Lot sizes would be 1.6 to 2.9 acres each and already contains a drainage swale and a storm water pond designed to handle drainage for the existing subdivision and the proposed lots and road extension. This leaves roughly a 13-acre “L” shaped field that is not easily farmed. The previous storm water management plan for Hickory Heights was approved by the County for the entire 33-acre parcel.
Jim asked if the petitioner had any further comments. Karla Chase introduced herself as the Conger’s attorney and explained that she would be speaking on the Conger’s behalf. Ms. Chase reviewed the Conger’s plans for this land and offered examples as to how this rezoning fit the Town Zoning Ordinance and how the granting of this rezoning would benefit the Town of Lamartine.
The Plan Commission discussed the zoning request.
Dean Birschbach made a motion to recommend to the Town Board that they grant the rezoning of 15.791 acres of land from Exclusive Agricultural to Residential. Motion seconded by Glenn Becker. Let the record show that five paper ballot votes were cast with the following results: Glenn—YES, Jim—YES, Tom—NO, Dean—YES, and Randy—No. Totals as follows: Three (3) votes for and Two (2) votes against.
The Plan Commission will recommend to the Town Board that this rezoning be granted. The following reasons were stated for recommending the granting of this rezoning:
Town of Lamartine Zoning Ordinance; Page 27 & 28—7.6 Standards for Rezoning:
#1—Adequate public facilities to serve the development are present or will be provided.
#2—Provision of these facilities will not be an unreasonable burden to local government.
#3—The land is suitable for development.
#9— The location of the proposed development to minimize the amount of agricultural land converted.
Chairman Jim Reitzner also noted that the strong comments all along in favor of this rezoning from Fond du Lac County Planner Sam Tobias was also a factor in recommending this rezoning.
Dean made a motion seconded by Glenn that all paper ballots be destroyed. Motion carried.
With no further business, Dean made a motion seconded by Tom to adjourn the meeting. Motion carried.
