Rezoning of Approx. 9.8 Acres of Land from Agriculture to Residential

The Clerk made introductions.
Vice Chairman Dean Birschbach called the meeting to order, explaining that this hearing would be informal and all parties would have a chance to speak.
Also present at this hearing were plan commission members; Roger Grade, Chris Newton and Glenn Becker, along with the town attorney Paul Rosenfeldt, petitioners Ed and Helen Haney, their attorney Patrick Madden and surveyor, David Jacob.
This property is owned by Ed and Helen Haney, W7604 Forest Ave Road, Fond du Lac, WI in the Town of Lamartine. More particularly described as:
That part of the NW ¼ of the NW ¼ and the NE ¼ of the NW ¼ of Section 13, Town 15 North, Range 16 East, Town of Lamartine, Fond du Lac County, Wisconsin. (Parcel I.D. No. T12-15-16-13-06-001-00)
The Clerk read the letter of intent dated, November 2, 2007. The letter stated that Mr. & Mrs. Haney owned approximately 31.53 acres of land and would like to rezone approximately 9.8 acres of land between the Fond du Lac River and Fenner Road from Agricultural to Residential. The letter noted that about 4.1 acres is currently used as residential property for the Haney’s existing home. The remaining 5.7 acreage to the south would be split into two new residential parcels.
Dean asked if the petitioner had any further comments or additions to their letter of intent. David Jacob showed drawings of the proposed layout, explaining that the lots are much larger than the one acre minimum the town requires. He explained that this property was also under Shoreland Zoning and would have to be reviewed by
Fond du Lac County Land Use Department before any sanitary or building permits were issued.
Patrick Madden summarized the 9 points from the Town of Lamartine Zoning Ordinance, 70.6 Standards for Rezoning. He stated that using these nine points that the plan commission uses to base their rezoning decision, this property met 8 out of the 9 criteria to be rezoned. Mr. Madden noted that the soil is high quality.
Dean asked if there was any public comment for or against the rezoning. No one offered any comments.
There was no opinion on this rezoning offered by Town Building Permit Issuer, Pete Michels or Fond du Lac County Planner Sam Tobias.
Discussion took place with the plan commission regarding the driveways of the new residences on to Fenner Road. This road is narrow and has no turn around. The road surface is recycled blacktop. The plan commission questioned if the road was adequate for more driveways and if this rezoning was granted would the town have to upgrade the
road. Damage done by heavy construction equipment on Fenner Road, and who would be responsible for the road repairs was also discussed.
Roger Grade made a motion to recommend to the town board that the rezoning be granted. Chris Newton seconded the motion. After further discussion Roger withdrew his motion.
Roger Grade then moved to recommend to approve the rezoning conditional on the property owner being made responsible for any damage done to Fenner Road during construction of the new homes on these two lots. Chris Newton seconded the motion. Motion carried 4-0.
Glenn Becker made a motion seconded by Roger Grade to adjourn the meeting. Motion carried 4-0.
