Rezoning of Approximately One (1) Acre of Land from Agriculture to Residential

The Clerk made introductions.
Chairman Jim Reitzner called the meeting to order, noting that this hearing would be informal.
Also present at this meeting were: Dean Birschbach, Tom Kramer, Roger Grade and Glenn Becker along with petitioners Greg and Carol Collien.
This property is owned by Greg and Carol Collien and is located south adjacent to W5469 Wonser Road in the Town of Lamartine, more particularly described as:
A one acre parcel from the following legal description of twenty acres: S25 T15N R16E N ½ NW ¼ SW ¼ Exc CSM #2310-12-68 & EXC COM 660.84’ S & 380.18’ E of NW COR SW ¼ TH N87*12’ 15”E 931.50’ S 60.13’ W930.17’ to BEG Town of Lamartine, Fond du Lac County, Wisconsin.
The Clerk read the letter of intent. The letter dated January 11, 2008 stated that Mr. and Mrs. Collien were requesting a rezoning of approximately one (1) acre of land that adjoined their residential property, from Agricultural to Residential, with the intent to create a residential lot for their eldest son to build a home. The letter further stated that a perk test had been performed and was passed for a mound system, and the family’s stipulation that this land remain in the Wonser side of the family would be continuing.
Jim asked if the petitioner had any further comments, concerns or additions. None were voiced.
Chairman Reitzner asked if any letters of opinions were received regarding this rezoning.
The Clerk read a letter of opinion from Fond du Lac County Planner Sam Tobias. In an email dated March 4, 2008, Mr. Tobias stated that the Wonsers own 36.64 acres on Wonser Road. If one (1) acre of land was split off for a new home adjacent to the existing home, the balance on the farm would be just over 35 acres, the legal lot size for A-1 zoned land. There are other homes in the area. The soils for this land are rated between 60-69, below what the town defined as the best soils for agriculture. Mr. Tobias felt that a rezoning to residential seemed appropriate given the neighboring land uses, the minimal impact of one lot, and the soil rankings.
No letter of opinion was offered by, Town Building Permit Issuer, Pete Michels.
Discussion took place regarding this rezoning.
Tom Kramer made a motion seconded by Dean Birschbach to recommend to the Town Board that they approve the rezoning of one acre of land from Agricultural to Residential. Let the record show that five votes were cast with the following results: Jim—YES, Roger—YES, Tom—YES, Dean—YES, and Glenn—YES. The Plan Commission will recommend this rezoning to the Town Board. The following reasons were stated for recommending the granting of this rezoning:

70.6 Standards for Rezoning (These Standards for Rezoning are listed in their entirety. The highlighted items are those given by the Plan Commission as reasons for granting this request) #1, #2, #3, #4, #5 and #9.
70.6 Standards for Rezoning
1. Adequate public facilities to serve the development are present or will be provided.
2. Provision of these facilities will not be unreasonable burden to local government.
3. The land is suitable for development.
4. Development will not cause unreasonable air and water pollution, soil erosion or adverse effects on rare or irreplaceable natural areas.
5. The potential for conflict with remaining agricultural uses in the area.
6. The need of the proposed development location in an agricultural area.
7. The availability of alternative locations
8. The productivity of the agricultural lands involved.
9. The location of the proposed development to minimize the amount of agricultural land converted.
The Plan Commission also noted that this rezoning was consistent with keeping the land in the family.
Roger Grade seconded by Glenn Becker made a motion to temporarily adjourn the Plan Commission meeting until 6:30 Pm at which time they would hear the Gupta Rezoning request. Motion carried.
