Rezoning of Approx. 5 Acres of Land from Agriculture to Rural District
Petitioner: Norbert and Kathleen Hoerth

The Clerk made introductions.
Chairman Jim Reitzner called the meeting to order, noting that this hearing would be informal.
Also present at this meeting were: Chris Newton, Tom Kramer and Roger Grade, along with the petitioners and interested town residents.
The property is owned by Norbert and Kathleen Hoerth and is near N6685 County Road C, and is more particularly described as:
Section 7, T15 N., R16 E. SE ¼ of the NE ¼, South 375 feet from the North property line along County Road C and East approximately 580 feet in the Town of Lamartine, Fond du Lac County, Wisconsin
The Clerk read the letter of intent dated January 12, 2007 from Mr. & Mrs. Hoerth. The letter stated that they
would like to rezone approximately five (5) acres of land from Agricultural to Rural District to build a home for their primary residence.
Chairman Reitzner asked the petitioners if they had anything more to add to the letter of intent. Mr. Hoerth added that the farmland on these five acres was poor due to limestone.
The clerk read an email dated February 21, 2007 from Sam Tobias. Mr. Tobias stated that the Town Zoning Ordinance seems to cover this situation with out the need for a rezoning. He noted Section 7.3 allows ag related residences, and even allows residences for folks that previously farmed.
No opinion was received from Building Permit Issuer Pete Michels.
Discussion took place regarding this rezoning.
Chris Newton moved that the Plan Commission recommend to the Town Board that this rezoning be granted.
Roger Grade seconded the motion. Motion carried unanimously.
The following reasons were stated for granting this rezoning. From the Town of Lamartine Zoning Ordinance, Dated June 8, 1998, Pages 27 and 28.
70.6 Standards for Rezoning (These Standards for Rezoning are listed in their entirety. The highlighted items are those given by the Plan Commission as reasons for recommending the granting of this request) #1, #2, #3, #4 and #5.
1. Adequate public facilities to serve the development are present or will be provided.
2. Provision of these facilities will not be unreasonable burden to local government.
3. The land is suitable for development.
4. Development will not cause unreasonable air and water pollution, soil erosion or adverse effects on rare or irreplaceable natural areas.
5. The potential for conflict with remaining agricultural uses in the area.
6. The need of the proposed development location in an agricultural area.
7. The availability of alternative locations
8. The productivity of the agricultural lands involved.
9. The location of the proposed development to minimize the amount of agricultural land converted
With no further business, Tom Kramer seconded by Roger Grade made a motion to adjourn the meeting. Meeting adjourned at 6:45 Pm.
