Rezoning request of 15.791 Acres of Land from Exclusive Agricultural to Residential

SE ¼ of the SW ¼ of Section 11 T15N R16E in the Town of Lamartine, Fond du Lac County, Wisconsin. The property is about a quarter mile South of Highway 23 on the East side of Fisher Road at the end of Treptow Lane. This parcel is Outlot 2 of Hickory Heights, the remaining land East of the existing development.
Larry and Debbie Conger, W7902 Forest Avenue Road, Fond du Lac, WI in the Town of Lamartine own this property.
Present at this meeting were Chairman, Jim Reitzner, Dean Birschbach, Randy Abitz, Tom Kramer and Roger Grade.
The Clerk made introductions.
With all notices having been properly published and posted, Chairman Jim Reitzner called the meeting to order.
The Clerk read the letter of intent. The letter dated April 12, 2005, stated that Larry and Debbie Conger were requesting to have 15.791 acres of land rezoned from Exclusive Agricultural to Residential. The parcel he was requesting to be rezoned was Outlot 2 of Hickory Heights, located at the east end of Treptow Lane north of Forest Ave. Road.
The Conger’s attorney Pat Madden noted for the record that his office had mailed a packet of letters for the Plan Commission to review. He asked if the Commission members had seen the letters. They answered that they had received the packets.
Attorney Madden then recapped the events of the Conger’s last rezoning hearing for this same property last month. (Please see the minutes of the Conger Rezoning and the Town Board Meeting Minutes both held on April 11, 2005). Attorney Madden also explained that the stormwater plan issues addressed at the April Town Board Meeting had been resolved and the Conger’s were in compliance with the stormwater plan at their current sub-division, Hickory Heights.
Discussion took place regarding the rezoning. Some concerns addressed were the fact that the agriculture land involved was good tillable land, the need for more lots in the township, the survey of town residents said that the majority of the people that responded wanted the agricultural land preserved.
Tom Kramer made a motion that the Plan Commission recommended approval to the Town Board to approve the rezoning from Ag 1 to residential. Roger Grade seconded the motion. Let the record show that five (5) votes were cast with the following results:
Jim—YES, Tom—YES, Roger—YES, Dean—YES and Randy—NO. The Plan Commission voted 4 to 1 to recommend the Congers request to rezone 15.791 acres of land from Exclusive Agriculture to Residential. The following reasons were stated for recommending the rezoning:

70.6 Standards for Rezoning
1. Adequate public facilities to serve the development are present or will be provided.
2. Provision of these facilities will not be unreasonable burden to local government.
3. The land is suitable for development.
4. Development will not cause unreasonable air and water pollution, soil erosion or adverse effects on rare or irreplaceable natural areas.
With no further business, Tom made a motion seconded by Randy to adjourn the meeting. Motion carried. Meeting adjourned at 7:10 PM.
